         <description><![CDATA[<div>In civil cases the two parties are called the plaintiff and the defendant. The plaintiff is the party claiming that the defendant infringed upon their rights. In criminal trials, the party sending an individual to jail is called the prosecution, they represent the people of the state/county/country. The person being sent to jail is the defendant.</div>]]></description>

         <title>The Burden of Proof</title>

         <description><![CDATA[<div>The burden of proof is the obligation or necessity to prove the facts that are in a dispute at a trial. In a civil case the plaintiff must convince the judge or jury that the facts support at least 51% of their side.<br>In a criminal case the proof must be beyond a reasonable doubt (95%) that the accused committed the crime.</div>]]></description>

         <title>The Defense</title>

The Defense evidence should disprove/discredit evidence presented by other party. They discredit them in a variety of ways: proving no alibi, the defendant claims self-defense or insanity defense (mentally deranged).</div>]]></description>
