The plaintiff is the party claiming that the defendant infringed upon their rights. In criminal trials, the party sending an individual to jail is called the prosecution, they represent the people of the state/county/country. In a civil case the plaintiff must convince the judge or jury that the facts support at least 51% of their side.

Negotiation- The parties talk face to face and try to settle the case
