USA vs. Alvarez court case

In 2007, Xavier Alvarez was an elected member of a water district board in California. He claimed to be a retired US Marine who had gotten many wounds in combat and had been awarded the Congressional Medal of Honor. None of his claims were actually true though. He had never served in the Marines nor won a medal of any kind. He also claimed to have played hockey for the Detroit Red Wings, and had once married a starlet from Mexico. Federal Prosecutors had counted him for violating the Stolen Valor Act. His lawyer argued that it was a violation of the First Amendment as it showed freedom of expression and speech and therefore the case should be dismissed. However, the court rejected this and sentenced to probation for three years and had to pay a $5,000 fine. He was the first person to have ever been convicted under the Stolen Valor Act.

Elonis vs. USA Court case

Anthony Elonis was arrested on December 8, 2010, and charged with threatening his ex-wife, co-workers, a kindergarten class, the local police, and an FBI agent. He had posted statements on his facebook page, that showed to threaten his ex-wife, co-workers, and many other people. Before the posts, his family had left him and he had lost his job at an amusement park. At his trial, Elonis asked to dismiss the threats as he claimed they were not true threats. He argued that he was a rap artist and the comments were a form of expression to help him deal with the events that happened in his life. He also posted YouTube videos that he made, noting that a similar artist had used language like his, and that this is not a threat. In the end, Elonis was sentenced to 44 months of imprisonment, and three years of supervised release. This court case represented the First Amendment, as his main argument was based on freedom of speech, expression, and that he can say as he wants.

Free Speech is one of the main outlines in the First Amendment. This amendment has impacted our lives drastically as without free speech, a simple conversation in public could be a battle for life, as you try not to say anything wrong. With free speech, people can freely express themselves through speech.

Freedom of Religion is also a key factor in Freedom in the First Amendment. This allows you to freely practice your religion with ease. Without this, people will be forced to either follow one religion, or not be religious, which for most people, is like life and death.

The First Amendment states that Congress cannot make any law stating or establishing a dominant religion in the country, meaning freedom of Religion. Another factor is speech, where people can express themselves freely without intervention. The same applies for Freedom of Expression, meaning you can draw or paint, or create whatever you want. Freedom of Press states that the press is free to write about what they want, even if the government doesn’t like it. Freedom of Assembly states that you can be with whoever you want, and the government can’t control you get to be with. And finally, the Freedom to Petition the Government states people are free to openly protest against the government as it shows that people can express themselves freely.
