Missouri Compromise
: developed
in 1820, the compromise was made to reduce tension between pro-slavery and
anti-slavery. At the time the United States was made up of eleven free and
eleven slave states, so when Missouri asked to become a slave state it would create
an unbalance between free and slave states in general but also unbalance in
U.S. senators. Henry Clay, also known as the Great Pacificator understood this
issue so he wrote the compromise to keep peace in America. The compromise
explained Missouri would become a slave state, and Maine (part of Massachusetts
at the time) would become a free state. It also drew an imaginary line along
the Louisiana Territory splitting off slave and free districts. In the court
case Dred Scott v. Sanford, the argument was surrounded by the Missouri
Compromise.

Dred Scott v. Sanford: A black slave, Dred Scott along with family originally owned by Peter Blow in St. Louis, Missouri. Later on american surgeon Dr. John Emerson bought the Scott family in 1833 and moved to Wisconsin (which a Free State territory, according to the Missouri Compromise.) In 1843 they all moved back down to St. Louis, but later that same year Dr. Emerson died. In 1846, Dred Scott tried to buy his freedom from Dr. John’s wife (Eliza Irene Sanford), but she refused. Scott sued her for this because he and his family have been living in a free state for eleven years. The case became so big that it moved from State to Supreme Court in 1857. Chief of Justice, Roger B. Taney argued against Scott becoming free for different reasons. First reason was that according to the U.S. constitution federal courts may only hear cases from the U.S. and since Scott’s ancestors are from another country sold as slaves, Scott was not considered part of the political community. Another reason was just because Scott’s status as a citizen in a free state, it didn’t exactly make him a U.S. citizen because he’s black. The decision was made and the judge decided Scott would still remain a slave because the court viewed slaves as property not citizens. Shown in the Constitution, the Fifth Amendment declares that the court is forbidden to take away property away from individuals with just compensation. Finally they said the Missouri Compromise is unconstitutional.

Later Outcomes of the Court Case: One
of the outcomes of the case was the appearance of the new political party, the Republican
Party. After Henry Clay and Daniel Webster died the Whig party didn’t really have
a chance of getting any good candidates so the party died. After the Dred Scott
case northerners, abolitionists, or people against pro-slavery were furious and
formed the Republican Party. The rivalry between deciding whether to have
slavery or not and democrat versus republican, continued to grow. The chaos grew
especially after the first republican president was elected, Abraham Lincoln.
From there on revolts and protests grew until the Civil War occurred. The point
I’m making to all of this is to say the court case Dred Scott v. Sanford is one
the causes of the Civil War.
