         <description><![CDATA[<div>We can see this amendment in action during court cases and sentencing. When the judge is giving out sentences they have to make it fair and not cruel or unusual. Another situation is when the police give out fines. They can’t make it excessive because that is against the 8th Amendment.</div>]]></description>
