Freedom of Speech was the third freedom given to the citizens of The United States. It was part of the First Amendment. Our founding fathers wanted us to have this right, so that all opinions, popular or unpopular could be shared. Back in the American Revolution Era the British would censor any newspapers that they thought were offensive and insulting to government. Americans Didn't want the government to control everything, wanted the citizens to be able to speak out in a public matter and share opinions on events, topics, anything really that the government wasn't sharing.

Near vs. Minnesota

This supreme court case happened in 1931. Newspaper editor Jay Near attacked local officials by claiming in print that they were associated with gangsters. The Minnesota government kept Near from publishing this article under state law. The law stated that anyone who published "malicious, scandalous, and defamatory." The supreme court decided that the Minnesota law restricted the freedom of press, and that prior restraint which allowed the government to hide information from the public was determined as a violation of the First Amendment. This helped establish the principle that the government can't censor or prohibit a publication in advance with few exceptions.

With the birth of the internet this right has been interpreted in many different ways. Now a lot more people share their opinions through social media sites such as Instagram or Snapchat. With this development more and more people have been able to discuss their opinions. However we feel that even though these people are speaking their minds they aren't doing it the way that the framers intended because now more people aren't following the guidelines of obscenity, Libel, Sedition, Etc.

This supreme court case happened in 1971 during the heat of the Vietnam war. The New York Times got a copy of an internal Defense Department report that detailed government discussions. These became known as the Pentagon Paper. Ruled 6-3 in favor of the Times. The court in this case recognized the need to find balance between journalist doing their jobs; and the government protecting national security. This places more pressure on the 4th estate as journalists need to use their powers wiser and be responsible with the knowledge.

1. Minnesota Voters Alliance V. Mansky- Minnesota law prohibits the wearing of anything that talks about voting or anti-voting in a polling place. Basically a guy walked in wearing a shirt that said "don't tread on me" he was not allowed to vote. He brought his complaint to the supreme court because he said it violated his freedom of speech.

2. Someone sued Chick Fil-a because the CEO of Chick Fil-A openly made homophobic comments to the media. They lost because the CEO was able to say that he was using his first amendment rights.
