Scott V. Sanford (1857)

1).After returning to Missouri, Scott sued unsuccessfully in the Missouri courts for his freedom, claiming that his residence in free territory made him a free man.2).The Supreme Court ruled that Americans of African descent, whether free or slave, were not American citizens and could not sue in federal court. 3).The Court also ruled that Congress lacked power to ban slavery in the U.S. territories.4.)Taney reached the conclusion that no person descended from an American slave had ever been a citizen for Article III purposes. The Court then held the Missouri Compromise unconstitutional, hoping to end the slavery question once and for all.

Tinker vs. Des Moines

(1969)
1. A group of students, including one John Tinker, planned to wear black armbands to school in protest of the Vietnam war. The principals of Des Moines created a rule against armbands in response. After being punished for wearing the bands, the students sued the school for violating their sense of expression.
2. The students believed that they had the right to express themselves and their opinion in school. The principals thought that the student's armbands would be a disruption to the learning environment and that their opinions should not be voiced on school time.
3. The Supreme Court ruled in favor of Tinker, as they believed the armbands represented pure speech, which was protected under the First Amendment.
4. The decision allowed more protests of a similar manner to take place, though limits would later be placed on the constitutionality of some protests.
