         <description><![CDATA[<div>1. The decision is wrong. Due process must be afforded to the accused.<br><br>2. The school head must have asked all parties including the teacher in-charge&nbsp; to appear before Child Protection Committee of the School. It must be noted that&nbsp; the case does not concern only the students but also the teacher. In the case of Amadora et. al vs. CA, the SC held that the student is in the custody of the school authorities as long as he is under the control and influence of the school. Hence, despite being on work immersion, the school may still be held liable and not only those who were said to abuse the victim.&nbsp;<br><br>More, Art. 2180 of the Civil Code is telling of the vicarious liability of the teachers and school administrators.</div>]]></description>

         <description><![CDATA[<div>Case No. 2<br>The decision of the school is somewhat a decison without analyzing the situation or the case of the students concerned. It is important to make first necessary imbestigation and try to resolved the problem within the school first.<br><br>The most appropriate decision is for the school head to call for the grievance committee in the school and make necessary imbestigation. When the incident is already clear, the principal will now report it to the Division Office for the necessary decicion since the case is really a grieve or serious case both in the students' part. Due process is needed.</div>]]></description>

We must follow the proper procedure.&nbsp;<br>2.Primarily the School head should refer the case to the school grievance committee and to the guidance councelor  to conduct a fact finding. And the school head can give a piece of advice to the parent to raise the complaint to the proper authority.</div>]]></description>
