De ahí la importancia de cumplir lo dispuesto en la carta fundamental  y la materialización 
el proceso de democratización de las Autoridades del Órgano Judicial y Tribunal Constitucional Plurinacional. Respecto la atribución y mandato constitucional la Constitución Política del Estado (CPE), instituyó un sistema sin precedentes como es la elección de las altas autoridades judiciales por voto popular encargando su preselección a la Asamblea Legislativa Plurinacional, la cual realizó mecanismos legales como los reglamentos, convocatorias y promulgación de la Ley N° 960, "Ley Transitoria para el proceso de preselección y elección de máximas autoridades del Tribunal Constitucional, Tribunal Supremo de Justicia, Tribunal Agroambiental y Consejo de la Magistratura."
