In my opinion, it would depend on what the husband told Mary. Obviously, if he told her that he would kill her right there and right then, then instinct would be to defend yourself. It's very unlikely, so I would say she should go to prison and serve her time for the crime she committed. I'm not sure about her baby, though, rather it should live or die.
