The Case of George Stinney

On June 1944, 14 year old George Stinney was executed via the electric chair by Judge Philip H Stoll. He was convicted of the murder of 2 girls, Betty James Binnicker and Mary Emma Thames. The trial lasted only 2 and 1/2 hours. He was offered court-appointed counsel, Charles Plowden. as he could not afford one, who when presented with the testimony by the plaintiffs, the three police officers, did not attempt to challenge their proposition. They accused Stinney of having already made a confession to the murder. Stinney's counsel did not call any witnesses, did not cross examine any witnesses, which was standard procedure at the time, and offered little to no defence. After deliberating for less than 10 minutes, the jury found Stinney guilty of murder. To contrast, juries will deliberate for at least 2 hours with serious cases like this one lasting on average, 2 weeks. The inconsistency of the court to provide balanced judgements led this tragic case. The need for firm sentencing law is vital which was recognised after this case as there was no suitable punishment for deliberate wrongful conviction of a defendant at the time. Despite the heavy injustices George experienced, the court had denied Stinney of fundamental due process not because of race but from the instability in appropriate sentencing at the time. The case directly led to the Civil Rights and Restorative Justice Project dedicated to research and support policy initiatives on sentencing procedures.
