AG v PYA Quarries LTD: </strong><br>Thirty locals complained of noise, dust and vibrations coming from the quarry. The court decided that the defendant's activities amounted to a public nuisance and an injunction was granted.</div>]]></description>

         <description><![CDATA[<div>A defendant has to prove that they suffered a loss above and beyond other members of that class. <br><br><strong>1. Castle v Augustine:</strong><br>Only the taxi driver that was hit but a golf ball while driving down the road can claim although the nuisance affects a class of people (anyone who drives down that road). <br><br><strong>2. Halsey v Esso Petroleum (1961): oil refinery </strong>spat out oil and damaged the paintwork of the claimant's car. claimant able to claim for the damage of paintwork<strong><br><br>3. Rose v Miles: <br></strong>D barrage blocked the river and C had to pay for alternative transport for the contents of his barrage. a nuisance claim can also be a financial loss.<br><br><strong>4.  Corby Group Litigation v Corby Council 2008<br></strong>council developed steelworks - toxic soil leads to children being born with deformed limbs<br><em>The personal injury can be tried under public nuisance because of an act or omission which endangers “life, safety health, property and comfort</em>."</div>]]></description>
