         <description><![CDATA[<div>In this the beginning phase is that it requires a jury, a grand jury. This will determine if there is enough evidence against the defendant to proceed the trial.An example of this can be when someone is being sentenced to death (back then when it was legal) they would first have to go through the indictment to see if they are "fit" to be executed.</div>]]></description>

         <description><![CDATA[<div>This amendment 5 also protects people from being trialed twice. The reason being is that you can not trial a person twice when the first trial has already gone through. This is to protect peoples emotion as well as protect them from others who might have more power to re-do the case to put them away in a longer sentence. Once the first and final trial is over whatever is needed to be done is done and can not be changed. Once you walk out the court you are either guilty or not guilty but you can't be guilty and then go on the second trial and not be guilty.</div>]]></description>

         <description><![CDATA[<div>This part of amendment 5 says that police officers or other can not use violence, force or intimidate you to saying that you did something when you have not. They are not allowed to threaten to hurt you or your family to get out a confession that you might or might not have done. If you have been asked a question such as when an officer pulls you over and ask if you know what you did was wrong. You can say you don't know or you can always plead the 5th amendment to not get into further unwanted troubles.</div>]]></description>

         <description><![CDATA[<div>This means that the government is not allowed to be able to take your house to use it for public use. They would have to either tell you and bargain with you in order for the person to give up the area to be able to continue the process. You can not be evicted without them warning or telling you about the situation. This protects us because if they want to use our property we can say no and decline the money offer they want to give us.</div>]]></description>
