         <description><![CDATA[<ol><li>The rules are called Civil Procedure Rules</li><li>No the clerk is not right as the new journalist is qualified. Section 47 of the CYPA says the public cannot attend youth court cases but bona fide journalists can. A bona fide journalist is someone who can prove their status as a qualified journalist with an ID card etc.</li><li>Section 121 of the Magistrates Court Act requires magistrates to sit in open court when conducting a trial, imposing a prison sentence or at a committal hearing (unless there are very specific reasons not to.)</li><li>Magistrates must disclose names of magistrates, For example, in the High Court case of R v Felixstowe magistrates, 1987 the Observer was refused name of a magistrate. Lord Justice Watkins said: “There is, in my view, no such person known to the law as the anonymous JP.”</li></ol>]]></description>
