         <description><![CDATA[<div>contractor is a organisation or sometimes a person, hired by the client to carry out the work that is required for the completion of a project. Contractor also have different levels such they are responsible for a wide range of tasks and people. Based on PWD 203A, there are a few obligations stated for the contractor.<br><br></div><div>1.      A contractor shall construct the project according to the terms agreed  and based on its scope within the specified time and quality. Clause 10 stated that contractor shall construct, complete, test and commission the works in accordance with the specifications. Contract drawing and any other documents specified in the contracts documents.</div><div>2.      Clause 48 stated that the contractor has the obligation to ensure the quality of his work. If there is any defect during the construction period and after completion, contractor has the liability to make good of any such defect until S.O  satisfied with the works. The contractor shall complete all such works with due expidition or within such time as may be specified by the S.O.</div><div>3.      Clause 10(g) state that the contractor shall provide and maintain throughout the contract period such number, categorised of qualified and compenent personnel necessary to perform the works</div><div>4.       The contractor also shall complete the whole of the works on or before the ‘date for completion’ as stated in clause 39.1 and if the contractor considers that the works have achieved practical completion, the contractor shall notify the S.O in writing to that effect.<br><br>-<strong>Nor Aisyah-</strong></div>]]></description>

Based on PWD 203A, there are several contractor's obligations stated. <br><br>The first one is to construct the said project that has been agreed  in according with the specified period of time and quality.<br><br>Secondly,  providing the performance bond to the employer as security deposit. This is common matter that the employer required from contractor<br><br>Next, the obligation of contractor in making sure their quality of works. Contractors have liability in making good such any defect if there is  any defect in construction period until they achieved the satisfaction of S.O. This is stated in clause 48 of PWD. <br><br>Lastly, clause 39 and 41 of PWD mentioned about completion and sectional completion.          <description><![CDATA[<div><mark><br>Based on the  standard form of contract P.W.D. 203A under section 10.0 (OBLIGATIONS OF THE CONTRACTOR) ;</mark><br><br>The Contractor shall :-<br><br>10. A -<br><strong>construct, complete, test and commission the Works in accordance with the Specifications, Contract Drawings and any other documents specified in the Contract Documents;</strong><br><br>In this clause, it explain that the contract is responsible to construct the building until completion ( hand-over phase) and the detail of the building shall follow the Specifications based on the contract document as it has already being agreed by both parties. This clause is explaining the general obligation of the contractor.<br><br>10. J-<br><strong>make good any defect, imperfection, shrinkage or any other fault whatsoever which may appear during the Defect Liability Period;</strong><br><br>This clause is explaining that any defect that occurs to the building during the Defect Liability Period (DLP) , the Contractor is liable to repair any defect of the building. This can be refer to clause 48 in the P.W.D , stated that the DLP is at anytime as stated in the appendix. If the period of DLP is not mentioned thus, the period will be 12 months from the date of practical completion of work. It includes any defect, imperfection, shrinkage, or any other fault.<br><mark><br>Based on the  standard form of contract P.W.D. 203A under section 39 ( COMPLETION OF WORK)</mark><br><br>Clause 39.1 <br><br><strong>Subject to clauses 38.3 and 41, the contractor shall complete the whole Works on or before the "Date for Completion" as stated in the Appendix or such extended time as may be allowed under clause 43 hereof.</strong><br><br>Clause 39.2<br><br><strong>If the Contractor considers that the work have achieved practical completion, the Contractor shall notify the S.O. in writing to the effect.</strong><br><br>This clauses is explaining that the Contractor need to complete the construction during or before the Date of Completion. This is to avoid the Extension of Time or Liquidated Ascertain Damages happen. In related to clause 41 of SECTIONAL COMPLETION, different type of completion date for different sections or parts of the Works shall be stated and mentioned in the Appendix or in the Contract Documents. <br><mark><br>Based on the  standard form of contract P.W.D. 203A under section 13 (PERFORMANCE BOND/PERFORMANCE GUARANTEE SUM);<br><br></mark>The Contractor shall provide a Performance Bond as it might be a substantial in the form as in the  Appendix by the approved licensed bank or financial institution incorporated in Malaysia in favor of the Government for a sum equivalent to five percent of the total contract sum. The performance bond shall remain valid and effective until 12 months after the expiry of the DLP or the issuance of the Certificate of Completion of Making Good Defects.<br><br><br><br><br><br><br><br></div>]]></description>

One of the clauses state that:<br>The Contractor shall<br>construct,complete, test and commission the Works in accordance with the specifications, contract drawings and any other documents specified in the contract document.This clause explains the main obligation of the contractor which is to construct and complete the project which has been agreed based on its scope and within the specified period of time and quality in the contract document.<br><br>Clause 39 is regarding the contractor obligations during completion of works. The contractor shall complete the whole of the works on or before 'the date of completion' as stated/agreed in the appendix of contract document or such extended time as may be allowed under clause 43 (Delay and EOT). If the contractor considers that the work have achieved practical completion, the contractor shall notify the S.O. in writing. Within 14 days of the notice receipt, the S.O. shall carry out testing/ inspection of works before issuing Certificate of Practical Completion.<br><br>Clause 41 is about sectional completion where different completion dates for different sections or parts of the works are stated in the appendix or in the contract document itself. The contractor must provide performance bond to the employer as security deposit. The performance bond shall be released or be refunded only when the Certificate of Making Good defects of the whole works has been issued.<br><br>Lastly, in clause 48 explained the contractor obligation on defects after completion. The contractor has to ensure the quality of his works.          <description><![CDATA[<div><br>According to the PWD 203A, the obligations of the contractors are :<br><br>1. <strong>TO CONSTRUCT WORK<br></strong>The contractor shall construct, complete,  test and commission the Works in the Specifications, Contract Drawings and any other documents specified in the Contract Documents. <br>(Clauses 10a)<br><br>2. <strong>COMPLETION AND SECTIONAL COMPLETION</strong> <br>Based on the PWD 203A,  the Contractor shall complete the whole of the Works on or before the "Date for Completion" as stated in the Appendix or such extended time as may be allowed under clause 43 hereof.  The contractor shall inform the S.O in writing to that effect if the contractor considers that the works achieved practical completion.<br>(Clauses 39.1 &amp;  Clause 39.2)<br><br>3. <strong>DEFECTS AFTER COMPLETION</strong><br>According to PWD 203A,  the S.O shall issue written instruction to the Contractor to make good such defects, imperfections, shrinkage or any other fault whatsoever at the Contractor's own cost at any time during the Defects Liability Period. The contractor shall complete all such works with due expedition or within such time as may be specified by the S.O.<br>(Clause 48.1)<br><br>4)<strong> INSURANCE<br></strong>Such insurance shall be for the purpose of personal injuries or death, damage or loss to property, movable or immovable, arising out of, or in the course of, or by reason of the execution of the Works and caused by any negligence, omission, breach of contract or default of the Contractor or any sub contractor, whether nominated or otherwise, or of any servants or agents of the Contractor or of any such sub-contractor, whether nominated or otherwise.  According to the PWD 203A, the obligations of the contractors are :

Firstly, clause 10(a) states that the contractor shall construct, complete,  test and commission the Works in the Specifications, Contract Drawings and any other documents specified in the Contract Documents.

2) Clause 10(b) states that contractor shall perform the Works in a proper manner and in accordance with good management practice and to the best advantage of the Government.

3) Contractor shall provide and maintain throughout the Contractor Period such number, categories of qualified and competent personnel necessary to perform the Works.

4) The contractor shall instruct and supervise its staffs and sub-contractor in carrying out the Works' repairs and other during the Defects Liability Period.
