         <description><![CDATA[<div>&nbsp;&nbsp;</div><div>Kidnapping is also interchangeably called abduction laws pertain to the, “guilt of kidnapping if s/he intentionally or knowingly restrains another person with intent to gain a ransom, use a person as a hostage or shield as a protection for themselves, facilitate a fight, inflict bodily harm or sexual abuse, interfere with the performance of political or governmental events, or force a person to provide goods or services with or without a collection of a debt,” (“Justia US Law”, 2015). This is a Class A felony but if the offender releases the victim before the court appearance with no harm it will become Class B.&nbsp;</div><div><strong>Hawaii vs. Texas Statue comparison:<br></strong>Both the state of Hawaii and Texas agree on kidnapping and false imprisonment in relation to their definitions. To compare the two focus heavily on the importance of understanding whether or not the individual was involving a ransom, holding against someone’s will, or obtaining some form of protection or “decoy” the individual against their will. The federal law covers a wide range of jurisdictional differences, international stipulations, and also considering kidnapping of a person even if they are no longer living.<strong><br></strong><br></div>]]></description>

         <title>Rape vs. Statutory Rape</title>

         <description><![CDATA[<div>Rape refers to the unwilling or forcefully taking of sexual pleasure from a victim of legal age of 18 years old. There is also a potential for violence and even murder in concurrence with this offense. This can potentially vary from state to state. Statutory rape refers to a willing intercourse between an adult and a sexually mature individual who is not of legal age to have such sexual relations. On average this is between the ages of 14-17 years of age.<br><strong>Hawaii vs. Texas Statue comparison:<br></strong>The state of Hawaii has abolished the use of the terms "statutory" and "rape" and now use the term "sexual assault" and are all classified under the same pretense. The state assumes that harsher action of underage sexual activity with someone that is at least 4 years older then the minor, is justified as rape as the minor is not mature enough to understand the implications of what they are doing. The law is placed with harsher punishments to cause a better deterrence to keep predictors away. This is very different with the state of Texas as statutory rape and rape are very different. Statutory rape is defined in Texas as someone of the age of 18 years old engaging in sexual activity with a person 17 or younger. Depending on the severity of the offense can fall under "indecency of a child, sexual assault, and aggravated sexual assault,"("The Law Office Of Matthew D Sharp", 2011). <strong><br></strong><br></div>]]></description>

         <title>Differentiating between Assault, Battery, and Mayhem</title>

         <description><![CDATA[<div>The definitions of <strong>assault</strong> and assault and battery vary from state to state jurisdiction. An assault has a lot of different circumstances but basically is an attempt to cause harm to another. Sometimes it is considered assault just by the vary threats of violence or the willingness to inflict harm on another. <strong>Battery</strong> is the intentional offense to bring physical harm to another and actually touching them in a violent manner without the victims consent. There are three requirements of battery: "intentional touching; the touching must be harmful or offensive; no consent from the victim,"("FindLaw", 2017). Though the common offense is the ill will of another person, assault is more the intent of causing physical harm to another and battery focuses on the action of touching another person in a violent and harmful manner to carryout the assault. In many ways mayhem is a degree of the criminal act of battery.<br>When people think of the word<strong> "mayhem"</strong> they often reference a large group of violent persons such as a riot, causing chaos and havoc in a public area. In the context of the law, mayhem refers to a specific form of battery. According to "The Law Offices Of Mart T. Lassiter: Experienced Aggressive Representation" (2008-2017), "To commit mayhem means to intentionally and permanently disfigure, maim, mutilate, or cut off the limbs of another person....However, mayhem is difficult to prove in many cases because in order for a crime to be mayhem, the disfigurement must be intentional. ” (The True Meaning of Mayhem).</div><div><strong>Hawaii vs. Texas Statue comparison:</strong><br>In the state of Hawaii, the focus on such crimes as assault, battery, and mayhem will focus on the extent of damage inflicted on the victim and why. In contrast, the state of Texas focuses on degrees of other acts of assault such as, "Intentionally or knowingly causing physical contact in a manner considered offensive or provocative," (Wheaton, D., 2017).There is a stricter definition of potential violent crime acts which allows the state to manage such crimes more effectively. Also the state of Texas fines and sentencing are more potent resulting in stiff fines of up to $500 as a class C simple assault misdemeanor. In the state of Hawaii, assault cases are a felony offense and are not likely to be met with a misdemeanor charge.</div>]]></description>

         <title>Hawaii Sexual Assault Case</title>

         <description><![CDATA[<div>The defendant, a Honolulu Police officer at the time of his offense, sexually assaulted a 14 year old girl. Caught by the mother, the officer admitted to doing this multiple times with her daughter and then left the scene. He was found the following day on the northern side of the island with his wrists slit and apologized to the officers on scene saying repeatedly that he had "let them down." [A grand jury indicted the officer on Wednesday. He was charged with four counts of first-degree sexual assault and two counts of third-degree sexual assault, and is being held on $500,000 bail,] (Boroff, 2016). </div>]]></description>
