         <description><![CDATA[<div>Under the Sale of Goods and Supply of Services Act 1980, anything you buy from a retailer must be:<br>Of merchantable quality.<br>Fit for its normal purpose, and reasonably durable.<br>As described, whether the description is part of the of the advertising or wrapping, on a label, or something said by the salesperson.<br>When you buy goods from a retailer, you make a contract with him. He agrees to provide certain goods to you for a certain price. If your purchase turns out to be faulty ,the retailer, not the manufacturer, is responsible to you and and must sort out your complaint. You are entitled to a refund, a replacement or a repair.<br>You do not have to take a credit note if your complaint is covered by the Sale of Goods Act. You can insist on a refund, a replacement or a repair.<br>If you have a genuine complaint about faulty goods, you can ignore shop notices such as ‘No Refunds’ or ‘No Exchanges’. Such notices cannot take away any of your statutory rights under the Sale of Goods Act.<br>You have no rights under the Sale of Goods Act if you simply change your mind about wanting goods. You also have no rights if faults are due to misuse of the product after purchase, or if faults should have been seen on examination or were pointed out at the time of purchase.<br>The person who purchases the goods holds the right under the Act. If you receive the goods as a gift, you have no contract with the retailer and don’t have the same rights. In practice, most retailers will oblige the user of he goods but this is a gesture of goodwill, not a legal requirement.<br>Your rights under the Act also apply to goods purchased at sale prices. They must be of merchantable quality, fit for their particular purpose and as described. If goods are being sold as seconds or shop-soiled,however, you cannot expect he same standard.</div><div>By Luke Cole  </div><div><br></div>]]></description>

         <description><![CDATA[<div>An advertisement is a message that promotes a product or a service or gives information to the public.Misleading advertising means advertising that deceives or is likely to deceive anyone that sees it. Misleading advertising may affect consumers’ choices regarding what they buy. It’s worth bearing in mind, that it may be an offence for a trader to advertise good or services if it is likely to mislead and therefore cause loss, damage or injury to the public.The following are examples of how advertisements can be misleading:<br><br></div><ul><li>Claims made about the characteristics of goods and services contain a false statement of fact. (Example: A product weighs 900g instead of 1 Kg)</li><li>The price or manner in which the price is calculated, is misrepresented. (Example: Goods are not offered at sale prices, but advertised as such)</li><li>The conditions of supply of the goods or service differs to that advertised. (Example: 'free delivery' actually involves a fee or charge)</li><li>The attributes of the advertiser, (the advertiser's identity, assets etc.) were untrue. (Example: 'an Irish based company' turns out to be based abroad)The Advertising Standards Authority for Ireland is an independent self-regulatory body of the advertising industry. Services use merchantable quality parts. 9. financial products state interest rates. 10. your contract is with the seller. This was made to make sure MR Malone was not depressed.          <description><![CDATA[<div>Consumer responsibility is taking personal responsibility for the environmental costs and consequences of your consumption patterns and lifestyle. <br><br></div><div><em>How does consumer responsibility fit in with zero waste?<br></em><br></div><div><strong>Zero waste is first about preventing waste – to reduce and reuse as much as possible before buying new, then about recycling and composting.  <br></strong><br></div><div>Everything we consume requires resources to produce. For every pound of goods produced, 71 pounds of waste is created during manufacturing. This waste comes from mining for resources, refining raw materials, manufacturing materials into a specific good, and the transportation involved with bringing the raw materials to production facilities and then the final product to the market.<br><br></div><div><em>How can I become a more responsible consumer?<br></em><br></div><div>At the store or on the street, before making a purchase or accepting a flyer, you can ask yourself "Do I really need this?" Free things -- like flyers on the street, signing up for informational brochures, or accepting junk mail -- come at a cost. People are faced with choices to consume every day, and not just at the checkout counter. <br><br></div><div><em>What are some tips to live Zero Waste?<br></em><br></div><div><strong>Reuse and repurpose to reduce waste.<br></strong><br></div><ul><li>Be creative with gift wrapping. Use old calendars, catalogs, maps, or newspapers. Don't have compostable bags to collect food scraps? Use newspaper to line your bin.  </li><li>Save used, empty food jars to store small household items or other food products, instead of buying special containers.</li></ul><div><strong>Bring your own!<br></strong><br></div><ul><li>Bring reusable bags when shopping. San Francisco passed the <a href="https://sfenvironment.org/node/2567">Checkout Bag Ban</a> requiring a charge for each checkout bag provided.</li><li>Eliminate one-time use serving ware. All products should be of merchantable quality.<br>According to the <strong>legislation</strong>, a standard term is unfair if it gives the trader an unfair advantage over the <strong>consumer</strong>, or takes away the <strong>consumer's</strong> legal <strong>rights</strong>. ... The quality of goods and services that <strong>consumers</strong> purchase are addressed by the Sale of Goods <strong>Act</strong> 1893 and the Sale of Goods and Supply of Services <strong>Act</strong>, 1980.The Consumer Rights Directive (CRD) came into force in 2014 and provides consumers with increased protection when they enter into on premises, off premises (doorstep sales) and distance contracts with web traders based in Ireland and other EU countries. Distance contracts include buying something online, over the phone, from a mail order catalogue or from a TV shopping channel. A range of provisions been introduced which businesses have to comply with. These provisions include bans on hidden charges, as well as an extended right of withdrawal period. You will also be obliged to refund consumers more promptly<br><br></div><ul><li>Avoid engaging in a prohibited commercial practice. Make sure that, as outlined in the CPA, your commercial practices are not unfair, misleading, aggressive or prohibited. Ensure that you comply with pricing and price display regulations, as set out in the CPA.</li><li>Avoid using unfair terms in your standard contracts. If you use standard form contracts in your business, you need to ensure that your contract terms are fair. According to the legislation, a standard term is unfair if it gives the trader an unfair advantage over the consumer, or takes away the consumer’s legal rights.</li><li><br></li></ul>]]></description>

         <description><![CDATA[<div>Consumers have many responsibilities, however they're often not aware of this. For example, many consumers fail to be ethical. A great deal of the products we buy are manufactured by slaves or sweatshop workers. These workers even include children. Consumers often don't bother to check if a product is fair trade or check where it comes from.<br><br>Consumers are also often ignorant of the environment. For example, many consumers don't bother to recycle plastic, creating a huge amount waste that will never decompose. This not only effects the environment terribly, but it also wastes a huge amount of the Earth's rapidly declining natural resources.</div>]]></description>
