         <title>When we are citing cases in the exam, do we also have to remember the reference to the law report? or just the case name and year?</title>

         <description><![CDATA[<div>Just the name will do and a chronological awareness of when it was decided. No extra marks will be given for the citation in an exam- and it could waste time. The names of both parties is the ideal, but if you can only remember one try and make it the first named party. If you really struggle and cannot remember a particular case name please still cite the principle of law that came from it- e.g in a decided case it was held that breach would be determined by an objective test of reasonableness. Not as many marks as citing Blyth v Birmingham waterworks but still some. </div>]]></description>

         <title>Essay structure </title>

         <description><![CDATA[<div>When we have the formative assessment - the 90 min with the current question released today. I think I may speak for many when I ask what kind of structure we should look to follow. I know we are expected to determine duty, breach etc and the case law around it, but are there any examples&nbsp;<br>we could potentially look at, or any guidance you could give about how we 'pad' the essay out.<br>I would suggest that you keep the structure of the tort of negligence in mind when answering the question. So duty, breach, causation, remoteness. Anything which might break that chain of causation. Any special harm that might require the use of additional authority e.g.&nbsp; consequential economic loss and psychiatric harm.<br>&nbsp; If you discuss all pertinent information, the answer will not require padding. Do not be afraid to show you knowledge of case law.&nbsp; You can always read your answer through at the end to make sure you are happy with it.<br>No, I am sorry there are no examples of worked up answers. Though some books are available in the library called Questions and Answers for many subjects. The tort one is sure to contain example answers to negligence problem questions.</div>]]></description>
