the case:  5th grade student with autism, and ADHD. the district established IEP's but Endrew's learning stalled. Endrew's parents rejected the IEP the following year because they felt it was the same as the previous year.  The parents removed him from public school and put him in private school and saw improvement. 

They tried 3 times to receive reimbursement from the district at the due processing hearing but failed due to his case being minimis latin for minimal.

IEP IS DESCRIBED IN LEGISLATION(LAW) BUT CLARIFIED IN THROUGH LITIGATION (LAWSUITS). LEGISLATION TELLS EDUCATORS WHAT TO DO. LITIGATION HELPS EDUCATORS UNDERSTAND HOW AND TO WHAT EXTENT THEY MUST DO IT.
