In 1795, Georgia Legislature granted the sale of cheap land to private corporations. This was repealed in 1796, however, due to fraud. In 1800, John Peck bought some land that was part of the original 1795 plan, and in 1803 he sold some of it to Robert Fletcher. Fletcher eventually realized that the 1796 ruling made his purchase from Peck void, and he sued for damages. A federal circuit court ruled in favor of Peck, and Fletcher subsequently appealed to the US Supreme Court.
