AI is something that has become the new norm in todays society. With the advancement of artificial intelligence, we have begun to see it in all phases of life. This is a part of why I decided to cover this topic for my legal guide, because of the constant use of it. In todays higher education, we have seen AI take a big step. Students have begun using it for assignments, essays and papers, and it has continued to make its mark in our education system. AI has not only been used by students, but administration has also used it to form relationships with students and help create content. AI has been used by both students and teachers, and will only see its audience increase.

The department of education would be the necessary governing agency when it comes to Artificial Intelligence. The DOE is in charge of making policies for, assisting to and helping to better the education system. This agency helps the president follow through with policies regarding education and putting laws made by congress into practice, both at the federal and state level. I feel that after reviewing the DOE, I learned that they hold a very important position when it comes to education. Not only does this agency assist education, but it is also in charge of funding as well. Funding is a big part of the education system, especially higher education, and making sure students are properly funded is vital.

One Federal law that goes hand and hand with AI is the FERPA law. The family educational rights and privacy act ensure the safety of the student, and using AI in education systems may jeopardize this. Because of this universities that use AI must make sure that the AI being used is okay under the FERPA act.

FERPA

Source- Federal Statute

20 U.S.C. 1232g

https://studentprivacy.ed.gov/ferpa

At the state level the TRAIGA act is one that also aligns with AI. This act watches over and mangees the development of AI systems that are being made. This is important because with Ai constantly evolving, it is good to have an act that regulates what's safe to use and what is not.

TRAIGA

Source- State Bill

https://capitol.texas.gov/tlodocs/89R/billtext/pdf/HB01709I.pdf

1. One risk management strategy that could be used for AI is teaching those who are gong to be faced with it. Training the people who are using AI how to properly use it can minimize risk and allow for it to be used in the correct manner.

Another strategy could be monitoring it. AI is widely used across many universities, and if your school is going to be using it, then it should be monitored. Watching those who use it, the way they use it and when they are using it allows there to be some type of security when using AI. This will also minimize the risk of something going wrong if there are always eyes on it.

The last strategy I think that goes hand in hand with AI is having some sort of insurance policy. Because it is used so much, universities should have an insurance policy in place for their programs. If it is going to be used, there should be a list of dos and don'ts that can cover the university.

One item in the professional code of ethics that I think relates to AI is academic honesty. AI gives students a chance to find answers and create work that may not be their own, so it is easy to lose that academic honesty. Because of this there are rules and regulations when it comes to using AI and it is not just a free for all. These tools are monitored to make sure they are used correctly by teachers, and there is a system in place that ensures that students are using it properly as well.

https://www.naspa.org/about/code-of-ethics/naspa-guiding-principles-and-code-of-ethics#:~:text=Act%20with%20integrity%20and%20honesty,continuous%20learning%20and%20skill%20development.

I think these laws listed throughout the powerpoint show just how important AI is and how it is evolving. A lot of these laws protect AI, and are even making policies to ensure that it is used the right way. This just shows how much it is being used in today's society. There are many universities who are quickly picking up the services that AI can offer and those numbers will only continue to increase. I think this law shows me that with time, AI is going to become normal within the education system. It seems like this is something that is going to be heavily relied on.
