I think it belongs to the photographer because he was probably holding the camera. He wanted the monkey to press the button. It's not as if the monkey is bothered about money, it's just the company trying to get money of the photographer.

I think that the man should have to copyright because he owns the camera and told the monkey to take the picture
I think PETA is wrong 
The monkey doesn't have a sustainable bank account so he can't do anything with it
It won't go to the charity

Also, the photographer didn't take the photo for himself, it was the monkey, meaning that he wasn't the one who created the image. 

If someone where to make a Creative Commons License, they could both own rights to the image and, they could both get equal share of it? Because, the monkey and the photographer were both present at the time.
