Falvo, mom of the affected student, took note and decided to report the teacher to the school. She demanded the ban of the practice since according to "The Family Educational Rights And Privacy Rights Of 1974" (FERPA) public institutions funded by the government must not release any educational records to the public without the written consent of the parent. The school refused and Falvo sued the school. The school argued back that just because another student knows the score does not mean they are "releasing it", the grading student simply reviewed the work, all school work would fall into the category even the simplest.
