         <description><![CDATA[<div>A teacher in Owasso Independent School District located in Tulsa, Oklahoma used peer grading as a part to score quizzes. A special needs student learning on a regular class named Phillip felt embarrassed by it since after they were done grading, according to the teachers instructions, they had to report the score of the quiz out loud. </div>]]></description>

         <description><![CDATA[<div>Kristja J. Falvo, mom of the affected student, took note and decided to report the teacher to the school. She demanded the ban of the practice since according to "The Family Educational Rights And Privacy Rights Of 1974" (FERPA) public institutions funded by the government must not release any educational records to the public without the written consent of the parent. The school refused and Falvo sued the school. Eventually the case went on to the Supreme Court.</div>]]></description>

         <description><![CDATA[<div>On November 27, 2001 both sides argued, Falvo arguing that under FERPA the scores of her kids grades were supposed to be confidential material and only known between the teacher and the student and not be released unless her consent. The school argued back that just because another student knows the score does not mean they are "releasing it", the grading student simply reviewed the work, all school work would fall into the category even the simplest. Finally on February 19, 2002 the supreme court gave the case to the school all 9 judgesstating that student assignments are not educational records under FERPA his or her rights are not violated by the method "peer grading", the scores are maintained by the students, teachers need help grading assignments. </div>]]></description>

         <description><![CDATA[<div>The significance of this case to our school is that we can grade our peers work without violating their students rights under FERPA. Teaches have more control over their classrooms and how they each it by engaging student in various tactics that will help them learn.</div>]]></description>
