According to a current professional.

I met with Angela Rodriguez, a high school counselor in San Antonio, TX. We discussed the top legal and ethical practices she faces as a high school counselor.
1) Confidentiality
A district confidentiality statement is read to students each time Mrs. Rodriguez visits with them. Students understand that by law Mrs. Rodriguez must tell the proper authorities if a student is in danger to themselves or others. As close relationships are formed with students, the lack of confidentiality often hinders what is shared and the closeness of the relationship she is able to form with her students.
2) Ethical Dilemmas
Mrs. Rodriguez faces many ethical dilemmas everyday. She relies on her team of counselors to consult with in order to ensure that she is making the right decision in the best interest of the student.
3) Child abuse
By law teachers and counselors have to report suspected child abuse and neglect within 24 hours.
4) Documentation
As counselors it is vital to document the work that they complete, as well as student, parent, and teacher content. Mrs. Rodriguez has email folders from previous contacts, multiple spreadsheets, and a checks and balance system for each task she performs. One wrong class or incomplete credit counts on student records can mean one of her students doesn't graduate. Counselors have a multitude of responsibilities and have to document accordingly to protect their jobs.
5)A Counselor's Role
Mrs. Rodriguez voiced that it is vital to know your role as a school counselor and what duties and assignments you're expected to perform. She shared that many times she had to tell administrators that she did not feel comfortable taking on a task or that the task that she was asked to do was not in her assigned job duties. At the end of the day you have to protect yourself as well as the students you serve, Mrs. Rodriguez shared.
( A. Rodriguez, personal communication, March 19, 2019.)

I explored the NSBA website and found interesting articles and news videos relating to legal issues for school districts relating to the education of undocumented children. It is the law for school districts to provide education to undocumented immigrants or any children in the United States. There are many counter arguments to this law that argue the negative effects on the legal children, as well as the cost and lack of space.

Additionally, the NSBA website contained information on special education and the IDEA act. I found it interesting to learn that special ed. funding is at a deficit and money will be taken away from general education to make up for it.

I viewed the ASCA website and found a their position statement for mental illness. According to ASCA, a counselor's role is to offer education, prevention, and short-term crisis and intervention resources. The site stated that schools are the usually the first place where mental illnesses are recognized due to noticeable changes in student behavior. The association further found that although 20% of all students suffer from mental illness, only 1 out of 5 students get treated.

The School Counselor and Student Mental Health. (2009). Retrieved March 20, 2019, from

https://www.schoolcounselor.org/asca/media/asca/PositionStatements/PS_StudentMentalHealth.pdf

The ASCA website also contained current legislative affairs. Perkins V law creates a stronger focus on career and technology education. Moreover, the Every Student Succeeds Act, which replaced NCLB, allocates funds for professional development opportunities for counselors.

With the influx of immigrants in the U.S., our school districts must adapt and accommodate a large number of students. These students require specific programs such as ESL.

According to the 1982 supreme court ruling of Plyler vs. Doe, illegal immigrants can not be denied a public education in the United States. It is unconstitutional for school districts to notify federal immigration agencies when an undocumented student registers ("The School Counselor and Student Mental Health", 2009). According to the Journal of Latinos and Education, 7% percent of children born in the United States are born from undocumented immigrants. Nativism concerns fuel anxieties about funding programs in school to support the influx of immigrant students registering (Davidson & Burson, 2017).

As counselors, we are the main point of contact and the support system for undocumented students. Many undocumented students feel they can not attend college. Counselors help students realize that they are able to attend college, and there are multiple programs available to help them. Counselors help students navigate the education system and allocate supports readily available to undocumented students.

Davidson, T., & Burson, K. (2017).
