Circumstances the court may review to determine whether an individual is in custody include: whether the suspect was  informed the questioning was voluntary and that they were free to leave at any time...whether “strong-arm tactics” were used by officers. This is supported by the decision in  J.S. ex rel. Synder v. Blue Mountain Sch. Dist case, in which the court found that J.S. made a website using crude and offensive language to attack the principal and his family personally. This may not somewhat connect to Smith v MCHS but since J.S. used bad language, it did disrupt the class. I can say that the profile that Kevin and his friends made did not cause substantial disruption in school and could not have led school officials to forecast significant school disruption.
