I began by examining the standards for police use of force. I looked into the guidelines used in Korea, the United Nations, and the United States. Unlike Korea, both the U.S. and the U.N. lacked clear and specific step-by-step frameworks for police response. In contrast, Korea’s standards were very detailed and clearly categorized.

Korea divides situations into five levels: compliance, passive resistance, active resistance, violent assault, and deadly assault. For each level, specific types of force or weapons are designated. For example, in the case of compliance, police may use handcuffs and verbal control. On the other hand, in a deadly assault situation, the use of maximum force, such as a firearm, is permitted.

Next, I analyzed a real case using the previously mentioned standards to evaluate how well the police in Korea follow proper use-of-force procedures.

The first case involves a person, A, who was reported for domestic violence. During the arrest, a police officer applied a chokehold, causing damage to A’s carotid artery and leading to surgery.

At that point, A had already been handcuffed behind his back after resisting. Despite this, the officer continued to choke him inside the elevator.

Chokeholds are generally allowed only in response to active resistance or greater threats. In this situation, the use of force was unnecessary and excessive, indicating a violation of the official use-of-force guidelines.
