What is The Historical Background of This Amendment

Before this amendment was added to the Bill of Rights, it was ratified. Back then there was unfair punishment to people who didn’t do anything wrong. In court people still to today face the death penalty. In 1972 they made the death penalty unconstitutional, but after a while they made the death penalty okay. Over the years so many people went through death penalty and there has been many people debating over if it is right or not. North Carolina hasn’t had someone go through the death penalty in more than 1 year. Each state is very different. This topic is debatable because when you put someone through the death penalty you really don’t know if they are guilty or innocent.

How is The Constitution a Living Document

In lots of court cases we still use the 10 amendments to protect people's constitutional rights. Some people believe that we should do everything the people who wrote the amendments did, but today is in the modern day and we interpret things differently as our society changes. Meaning we should use these amendments differently but still use them. To this day the constitution is still used everywhere, to prove if you are guilty or not. For example, you don’t want to give someone a crucial or unfair punishment depending on what they did, so that’s why there is the 8th amendment and still breathing.
