         <description><![CDATA[<ul><li>Lawmakers can change laws to make them more clear. This is easy to defend a certain situation that can be marked as unconstitutional. Multiple amendments throughout the years have been revised.&nbsp;</li><li>&nbsp;States and federal courts can invalidate laws made by the state that violate constitutions. In the constitution, powers are not mentioned specifically.&nbsp;</li><li>&nbsp;Anti- Federalist argued that the new Constitution would create an new powers that would hurt them but would affect federalists.</li><li>Courts had the right to make laws which implied they had the right to take down laws as well.</li><li>Jefferson argued that the provision of the Judiciary Act of 1789 under which Marbury had brought his case to the Supreme Court violated Article III of the U.S.&nbsp;</li><li>Jefferson and Jackson tended to argue for a view that would give relative equality to each branch of the government in interpreting the Constitution.&nbsp;</li><li>Similarly, parties who bring their cases to the courts must establish their own standing—that is, their own direct interest in the outcome of a given case.</li><li>Courts sometimes refuse to render decisions about issues that they consider to be political questions and therefore entrusted to the other branches of government.&nbsp;<br><br></li></ul>]]></description>

         <description><![CDATA[<div>The Judicial Review allows the courts to declare an unconstitutional law or action by a chief executive to be void. &nbsp;</div><ul><li>Many proponents of Judicial review have argued that this power is ultimately more important than the power of invalidate federal legislation.</li><li>Hamilton argued that it was a logical consequence to the idea of a written constitution ratified by the people and unchangeable by ordinary legislative means. The Judicial Review would distinguish America from nations such as Great Britain which did not have written constitution and where the legislative branch was considered sovereign.&nbsp;</li></ul>]]></description>
