This treaty is created to solidify, build, and renew existing agreements between the British Crown and Indigenous peoples in the Maritimes, primarily the Mi'kmaq and Maliseet, following periods of conflict. The treaty was to establish a more peaceful relationship after periods of warfare, such as the Seven Years War. Also, the purpose of this treaty is to end hostilities and prevent future conflicts and guarantee the rights of the Indigenous people, such as hunting, fishing, and land use, without British interference.

Governor Edward Cornwallis punished the Mi'kmaq for refusing to engage in treaty making by offering a reward of ten guineas for any Mi'kmaw captured or scalped in the region. This treaty included a promise to establish "truck houses" for the Indigenous peoples, but no truck houses were built. This treaty was created to end the hostilities and promote cooperation between the British Crown and the Mi'kmaq people.

The treaty was signed in Halifax, Nova Scotia, in 1760 and 1761. This treaty affirmed that peace would prevail, and the Mi'kmaq would be able to continue their traditional trading and livelihood activities. The 1760-61 treaties guaranteed the Mi'kmaq, Wolastoqiyik, and the Passamaquoddy peoples the right to hunt, fish, farm, land, and earn a reasonable living without British interference.
