         <description><![CDATA[<div>This amendment includes:<br>freedom of speech-You can say almost anything as long as it doesn’t cause harm to others.<br>&nbsp;freedom of religion- You have the freedom to believe, but the freedom to act is limited. Additionally, the government can’t establish an official religion, favor one over others, and stop people from praying, going to a house of worship, and doing rituals of their faith.<br>&nbsp;freedom of press- The press is allowed to release news without censorship, even if it is about topics like a government official having wrongdoing. Censorship may happen in some cases.<br>freedom to petition and assemble- People can complain to the government without consequences, and can gather people as an assembly to do so without being stopped. While marches and sit-ins are allowed, the government controls the time of day, place, and way it happens.<br>freedom to associate- People can get together to share values, interests, goals, and ideas. However, some things are considered associations and some are not, meaning this doesn’t apply to some scenarios.<br><br></div>]]></description>

         <title>Carson v. Makin(2022)</title>

         <description><![CDATA[<div>The Supreme Court decided that it is against the First Amendment for Maine to not include parents sending their children to religious schools in the state’s tuition reimbursement program. Originally, this program was to pay for children in rural districts with no public school to go to a private school or public school in other areas. However, it was changed in 1981 to state that religious schools would be excluded, which the judges ruled against.<br>This was against the freedom of religion because it protects indirect coercion or penalties(including outright ones) against the free exercise of religion, and the parents sending their children to religious schools got the penalty of not having the tuition covered for by the state.<br><br></div>]]></description>

         <title>BE and K Construction Co. v. National Labor Relations Board (2002)</title>

         <description><![CDATA[<div>BE and K Construction Company claimed that unions had took part in lobbying, litigation, and unplanned activities in order to delay one of its hired projects because the employees were not union workers. After these claims were refuted, the National Labor Relations Board delivered an administrative complaint, saying that the company had broken the National Labor Relations Act by filing and maintaining its lawsuit. The NLRA doesn’t allow employers to restrain, coerce, or interfere with employees' exercise of rights related to self-organization, collective bargain, and perform other concerted activities.<br>The Supreme Court decided that the NLRB couldn’t file a complaint against the company for filing a losing retaliatory lawsuit for something that wasn’t baseless, as it violated the First Amendment’s right to petition. This was because the BE and K Construction Company’s lawsuit counted as a petition, and was protected by the Bill of Rights.<br><br></div>]]></description>

         <title>Current Event: Abortion Protests against and for Roe v. Wade Overturn</title>

         <description><![CDATA[<div>The First Amendment protects the right for people to protest against a law, including Roe v. Wade which protects women's rights when wanting an abortion. Some people believe that babies within the womb count as a living being, and abortion kills that living being. Therefore, they go to the streets to protest against a law that protects the right to abortion. They are able to protest publicly because the First Amendment of the Bill of Rights gives them the rights of speech, petition, and assembly.<br>Protestors are allowed to freely talk against Roe v. Wade due to their right to free speech, and their right to petition and assembly protects their ability to complain to the government without consequences, and even gather people to do so in a protest.</div>]]></description>

         <title>Current Event: Black Lives Matter</title>

         <description><![CDATA[<div>After George Floyd’s death on May 25, 2020, the Black Lives Matter movement gained a lot of recognition and thousands of protests happened. This along with the death of Breonna Taylor and Rayshard Brooks caused innumerable people to see and protest against the unfair treatment of people of African origins. The protestors are able to go to the streets and march because of the First Amendment. This amendment protects the right to assemble, petition, and freely speak. The right to assemble and petition covers protesting against police brutality, as it states that people are able to complain about the government without any consequences and gather to complain about it. Americans’ right to free speech also allows them to use whatever choice of words they want to protest as long as it isn’t hurtful or libel. However, police are also given the right to use military weapon and combat gear because the government is able to control the time, place, and way the protest happens. On the other hand, this has sparked some debate about whether it was really necessary or not. Ashley M. Eick believes that the state would have to prove a “clear and present danger” of violence in order to deploy military forces. She is able to complain about state/police actions like this due to her right to free speech and petition.<br><br></div>]]></description>
