There have been many variations of this story in multiple countries but the origin is believed to be from  a "mixture of the bloody American Revolution and the existing Dutch traditions of the New York region. It is that connection between the regional legend and its basis in history that creates an historic urban legend."  The story of a soldier leaving a party and seeing a man on a horse, and when the and falls on him, he sees he had no head riding the horse.

An American cannonball beheaded him, and the splintered remnants of his head were left on the battlefield while his companions rushed to carry his body away. His rides are referred to in modern renditions of the story as taking place around Halloween, which is when the fight took place.

At 6:45 a.m. as the bus driver was telling ghost stories because it was the days before halloween. The students claim the horse rode along side their bus.

This is a Legend derived from the Headless Horseman story and told for decades. There was a report of a sighting of "El Muerto" in 1917 by a couple on their way to San Diego. The couple reported that they passed him on the road with no head and he was screaming something they could not understand.
