SB 834 and HB 1207 - "An Act Relative to Child-Centered Custody" [MA Sate Law]

*Just released by the Joint Committee on the Judiciary. In its current form it is vastly improved form its original version but it still has elements that are of concern to us" (Custody Awareness Collaborative).
*"Small group of individuals who are focused on the rights of parents over well-being of children is active in lobbying for and shaping legislation that will impact children in the Commonwealth" (Custody Awareness Collaborative).
* Creates 'one size-fits all' custody determination model with a strong presumption of forced joint custody. (Massachusetts Law Reform Institute: MLRI)
*Under this scheme a significant number of the factors and limitations to be considered in making child custody decisions focus on the relationships between parents not the interests of the children. (MLRI)
*The factors and limitations mandated for consideration actually put children at risk as they dissuade parents from raising legitimate concerns about troubling parenting styles, safety concerns, and the need for stability for a particular child. This is because a person raising such concerns risks being branded as an "unfriendly parent". (MLRI)

Do not pass SB 834 and HB1207

Implement SB 741
*SB741 would create a new definition section for inclusion in the G.L. c.208. This new section, 31B, would allow parents to choose to use the terminology of "decision making responsibilty, "residential responsibility", and "parenting schedule". These terms would take the place of the current language of legal custody, physical custody, and visitation which many parents find divisive.

MLRI

Custody Awareness Collaborative
