2.)    List  and elaborate in details two responsibilities of developer in the aspect of strata title. (10 marks)

1.  Define the following term and provide appropriate example. 

 

a) Accessory parcel 

- parcel that is exclusive for the parcel proprietor 

Example : car park 

 

b) Aggregate share units 

- The total share units of all parcel 

 

c) Building 

- Structure with a roof and wall standing in one place and cannot be move 

Example : Factory, Office and house 

 

d) Common property 

- Property that all proprietor can use and share 

Example : Park, gym 

 

e) Delineation plan 

- Plan that showing delineation of land parcel 

 

 

f) Floor area 

- Area that occupied by the parcel 

 

g) Land parcel 

- Parcel which contain building that not more than 4 storeys which is held under strata title 

 

h) Management corporation 

- Corporation which is establish under section 39 to manage the strata building 

 

i) Parcel 

- In relation to a subdivided building, means one of the individual units comprised therein, which is held under separate strata title and in relation to a subdivided land, means one of the individual units of land parcel. 

 

j) Share units 

- in respect of a parcel, means the share units determined for that a parcel as shown in the schedule of share units. 

 

k) Proprietor 

-  refers to a parcel proprietor, a person or body for the time being                         registered as the proprietor of a parcel, as well as to the proprietor of a provisional block, a person or body for the time being registered as the proprietor of a provisional block unless expressly provided                          otherwise. 

 

l) Special building 

- any building occupied before June 1996. 

 

m) Storey 

- any horizontal division of a building whether or not on the same level throughout and whether above or below the surface of the ground. 

 

n) Strata plan 

- a location plan and a storey plan, and includes a plan of division or                          amalgamation of any parcels shown in an approved strata plan and in the case of land parcels, includes a delineation plan. 

 

 

o) Storey plan 

- a storey plan under subsection (3) of section 10. 

 

 

2.) List and elaborate in details two responsibilities of developer in the aspect of strata title. 

- developer is responsible to ensure strata title registered to parcel owners as soon as possible. 

- For building completed before 23.2.1990, developer must make compulsory application not more than 6 months from 23.2.1990 or not more than 6 months from date of first sale or agreement 

b) Issuance of the strata titles to the parcels upon purchasers taking vacant possession of the parcels and transfer of the strata titles thereafter.

c) Establishment of the new Strata Management Tribunal.

 

The positive impact of Strata title act amendment towards the built environment in Malaysia is to help resolve problems or disputes among residents and interested parties simply, quickly and cheaply with the enforcement of Act 757. The management of the building must attain the high standard set to ensure the parcel’s owner’s comfort and well-being, including through Act 757.  The building must be ensured having the right criteria plan as the amendment stated. Government can overcome the abandoned housing project cases which are very serious issues this day through Strata title act and protect the parcels’ owners from abandoned projects.
