Popular Sovereignty: The Compromise of 1850

5 laws regarding slavery were passed in September of 1850. The five laws passed were one being the fugitive slave act, this was about interests regarding slave holding and the Northern Free-Soilers. The second law passes was slave trade in Washington D.C., this was created to stop a crises from happening between the North and South. Another component of the Compromise of 1850 was California entering the Union as a 3 branch government and a free state. The last component of the compromise of 1850 was the act passed about setting a boundary debate between Texas and New Mexico which also helped create a 3 branch government in New Mexico. The Popular Sovereignty dynamic nature of our government represents that their were representatives that had to contribute to help five major laws be passed about a major issue back than which was slavery.

Limited Government: The Civil Rights Act of 1866

This was an act where they granted United States citizenship to former slaves. This was than passed as an amendment so the future people in Congress couldn't change the act and refuse citizenship to former slaves. Another grey area was the Congressional authority to address the black codes that disparaged citizenship for former slaves. For both of these issues the 14th amendment was then created. The limited government dynamic nature of our government represents the civil liberties given to the black people and former slaves that became a part of our constitution.

Federalism: McCulloch vs. Maryland 1819

In this case Maryland wanted to impede operation of the second bank of the U.S. by striking a tax on all banks not chartered. A National bank was having a little debate when they were trying to figure out how to read the Constitution. Chief Justice Marshall said that under the Necessary and Proper Clause a National bank is unconstitutional. If an act or law is relevant within the Constitution than it is Constitutional. This case also helped put boarders on having the Supreme Court decide is something is Constitutional or not. The Federalism dynamic nature if our government represents that in this case there was someone who was deciding if it was Constitutional or not.In some cases there isn't so we have to figure who will have all the power to decide is something is Constitutional or not.

Separation of Powers and/or Checks and Balances: United States vs. Nixon 1974

In 1972 the Republican candidate Nixon was running for reelection against a Democrat. There was a burglary in the Democratic headquarters five months before the election. There was audiotape recordings of Nixon talking about the break in with the burglars . Nixon still denied everything. In 1974 the Supreme Court came to the decision that Nixon needed to gibe them the recordings. The Supreme Court said that within the Constitution the Judiciary branch has the say and not the Executive branch. They said "no president is above the law". Nixon gave the Supreme court the recordings and it showed his connection to the burglary. The Congress was in the process of impeaching Nixon but then Nixon just resigned so he didn't have to deal with all of the hearings. The Separation Powers and/or Checks and Balances dynamic nature of our government represents that Checks and Balances doesn't always go above what the Constitution says and/or interprets and the executive branch doesn't rule above all and doesn't have the say in all things.

The Supreme Court said Congress can not take things from the past in Federal Courts to open up cases again to make different decisions. Someone who writes for the court said that those actions were not approved by Congress by the Judiciary so it's not Constitutional. Separation of Powers shows the stability nature of our Constitution using the Plaut vs. Spendthrift farm Inc by showing the restricted legalized force that is being held in the court. It separates the powers between everybody.

Limited Government: Ex parte McCardle

McCardle was writing stuff because he was a newspaper publisher during the civil war. They were not the nicest of things to say in the articles. He got arrested by a military commander and this was allowed because of a law passed by the Congress. McCardle brought this to court but the judge sent him back because he said it was legal. McCardle brought this to the Supreme Court and they ruled in favor of him and took full power over Congress by ignoring what they said. Limited Government is showing who is overpowering the others and who really has the say between all of them and will do whatever they want.

Federalism: United States vs. Klein

Klein's property was taken during the civil war. A presidential remission was made was like proof that did not have any support towards the rebellion. This made people think they could make a petition to get there property returned. Congress said what the president said was invalid as evidence for taken property. Congress than said if there was a "misunderstanding" without proper evidence than they could make legal decisions. Klein got a letter that gave him recovery of his belongings. Federalism shows the stability nature of our Constitution using the United States vs. Klein case by in the end the president and the Congress both agreed with each other and shared power.

Popular Sovereignty: Trump winning electoral votes but not winning popular vote

In the 2016 election Trump won presidency. There was an outrage going on about how he won the Electoral College votes but not the popular vote. This could count as Popular Sovereignty because this amendment failed but having electoral votes count more than popular votes. Popular Sovereignty is all about the representatives of the government being who the citizens choose. But if the citizens didn't technically choose Trump then why is he president. This Popular Sovereignty amendment is failing to work.
