Robert Baltovich was accused of murdering his girlfriend Elizabeth when she went missing, based on eyewitness statements. Elizabeth’s body was never found and the only physical evidence recovered was her blood in the back of her car. The eyewitness claims she saw Robert driving Elizabeth’s car on the day she was last seen. They utilized tools such as hypnosis to create evidence against Robert which ultimately led to his conviction. (Harland-Logan)

Use of hypnosis- Hypnosis was used to receive “more information” from an eyewitness regarding Robert's presence on the day of Elizabeth's disappearance. However, hypnosis was proven to be scientifically inaccurate as there is no way to differentiate between imagination and accurate recollection. Furthermore, it was declared to have no role in a criminal trial. (Harland-Logan)

Other problems with eyewitness testimony- There were numerous issues with eyewitness testimonies aside from the utilization of hypnosis. Specifically, when presented with a photo lineup, one witness identified Robert through a “process of elimination”. It has also been proven that witnesses are often wrong, therefore with no physical evidence relating Robert to the crime, there was no basis for his incarceration.

In my opinion, a wrongfully convicted person should be awarded compensation but only if there is evidence acquitting them from the crime. Although legally it makes no difference, morally I find it more comforting when someone is acquitted of a crime as there is evidence proving that they are not guilty, as opposed to when there is just a lack of proof convicting them. I think one million dollars for each year spent incarcerated is fair, plus any support for their children.

One topic that surprised me after having read this case, is how certain people can be treated differently based on their prejudice. It also made it more obvious that law enforcement can become tunnel visioned based on the information they are given. In my opinion, the disappearance of Elizabeth was immediately treated as a murder with Robert as a suspect based on eyewitness statements. The rest of the investigation seemed to proceed with the assumption that he was guilty before he was proven guilty in a court of law. It is possible that information was missed when trying to find evidence that proves Robert guilty. (Harland-Logan)
