If these laws were broken then both people would be arrested. The Supreme Court said that it was unconstitutional to ban interracial marriage. Though separate states still made it illegal despite the counties law. White governors continued to try and make the Supreme Court pass the law but it never did. In 1996, Clinton makes it illegal for same sex couples to get married. Though a lot of states since then started to make it legal. By 2004, only 11 states still made it illegal. It wasn't until 2015, 3 years ago, that same sex marriage was passed by the Supreme Court. The difference was interracial marriage was seen as unconstitutional by the state but not the supreme court, where for same sex marriage couples it was the opposite.
