Lawis the set of rules and standards by which a society governs itself. In democratic societies, law resolves conflict between and among individuals and groups and protects individuals against government power. It defines criminal acts and determines the punishments for them. These are only some of its many functions.

Principles of Democracy in the Judiciary

According to our democratic principles, every person should have a free and equal opportunity to pursue individual goals and desires. So that one person’s pursuit of happiness does not infringe upon another’s, we have agreed upon certain guidelines for our behavior. We do this by voting for elected representatives who then write our laws. Sometimes the meaning of a law passed by a legislature and enforced by the executive branch is unclear.

A central purpose of the courts is to promote the rule of law. The idea behind rule of law is that no individual, group, organization, or governmental entity is above the law. Everyone must obey the law and be held accountable if they violate it. Laws must be clear and known to all. Laws must be equally, fairly, and consistently enforced.

The Function of Trial Courts

In theory, trial courts are the places where the truth comes out about whether someone has committed a crime or has caused some sort of damage to someone else’s reputation, property, or body. Criminal trial courts can hear cases about crimes, like burglary, murder, or driving under the influence of alcohol or drugs. Civil trial courts hear cases where one person or group thinks another person or group should pay for causing harm. In both types of trial courts, judges or juries determine the facts of the case and then apply the relevant law to decide the outcome of the case.

Trial courts listen to testimony, consider evidence, and decide the facts in disputed situations. To make sure that the process is fair, certain legal principles govern the way the two sides present their evidence and the way the judge or jury considers that evidence and makes a decision. For example, in a criminal case, the government must convince the judge or jury beyond a reasonable doubt that a crime occurred and that the accused person committed the crime.
