         <description><![CDATA[<div>Derek buys a large house in an area with a mix of private houses, shops and restaurants. He uses the house as a nursery school for twenty-five children between the ages of two and five. During lunchtime, if the weather is fine, the children play in the back garden. The noise of the shrieking children disturbs diners on the terrace at Eli's neighbouring restaurant, and Eli notices a reduction in the number of lunchtime customers.</div><div>&nbsp;</div><div>The children have also invented a game which involves trying to throw sticks and stones from the garden over a tall hedge into Farzana's neighbouring garden. Sticks and stones regularly fly over the hedge at lunchtime regularly breaking the windows of Farzana’s house.&nbsp;</div><div>&nbsp;</div><div>When Derek refuses to pay for the damage Farzana cuts down most of the hedge and burns a pile of the clippings on a bonfire each lunchtime for a week. The smoke is so acrid that Derek has to keep the children indoors and several of Eli's customers complain and leave without ordering.</div><div>&nbsp;</div><div>Derek uses a strong chemical to clean the toilets of the nursey school and stores the chemical in containers in his shed. Unfortunately, the chemical leaks through an invisible crack in one of the containers onto Eli’s land and cause considerable damage to outdoor furniture on his terrace.</div><div>&nbsp;</div><div>Advise the parties.</div><div><em>&nbsp;<br></em><br></div>]]></description>

         <description><![CDATA[<div>Private nuisance - intangible damage. Reasonable user? (Sedleigh Denfield v O'Callaghan - balancing the rights of owner and occupier.&nbsp;<br><br>Interest in the land? - Eli would appears to own the restaurant/tenant. Customers? - no - no interest (Malone v Laskey; Hunter v Canary Wharf). Defendant - control of nuisance (Matania) - arguable due to being responsible for the children. No substantial interference. <br><br>How? Locality - Sturges v Bridgman - 'houses, shops and restaurants' - therefore appears to be fairly urban and therefore should expect a certain degree of noise.&nbsp;<br><br>Duration and frequency - De Keysers - only during lunchtime presumably 5 days a week. Probably get most of their business at the weekend if a restaurant when the children won't be there.&nbsp;<br><br>Abnormally sensitive due to the dining area outside. If it was inside they wouldn't hear it (Robinson v Kilvert).&nbsp;<br><br>Emanate from the land? Launching pad? - Lippiatt.<br><br><br></div>]]></description>
