When his girlfriend came home her daughter was coughing and throwing up. Her daughter was brought to the Delano Regional Medical Center they found that her stomach began to distend and her condition deteriorated . She was then transfered to the Kern Medical Center were they discovered she had "Blown Pupils" (formed from blunt forced trauma).  Within 20 minutes of her arrival the Diagnostic surgery revealed her bowel, duodenum, and pancreas were “cracked in half”. A pediatrician Dr.Jess Diamond found a tear in her hymen and bruises around her "area". The doctored believed that she was not hit or ran into a door but was sodomized. Bernavides was convicted of rape, sodomy, first-degree murder and lewd conduct with infliction of great bodily injury. At 8:00 PM a black Mazda drove by slowly, inside the car was a man holding a gun with a laser light. The car stopped a couple of blocks away. Davila got out of the car with the loaded weapon and walked down the trail between one house and another building that was across the street from the Stevenson's House. Davila stood next to the A/C and took aim toward the Stevenson's House. He fired multiple times in that position and ran toward the house in the middle of the street and shot a couple of more times. A eyewitness Kent Reed (was attending another birthday party in the area)  saw Davila exit the car with the weapon in his hand. Reed gave a description of the car and the gunman. The following day from the descriptions Reed had gave Davila's photo line-up came up. Another witness at the party that Reed was at said he saw the gunman  point the laser at Jerry Stevenson, when he failed to shoot Jerry the gunman got frustrated. Nichcole Blackwell called the police saying that her car might have been involved with the murderers. She stated that she lived with Davila. Detective Brent Johnson arrested Davila in the afternoon of April 8. Davila gave four statements in seven hours. In the fourth statement Davila stated that he was trying to shoot Jerry Stevenson ( who was his rival ) not the two other victims who were shot.
