         <description><![CDATA[<div>Penelope Flores, an elementary school counselor at Bryant Elementary in the Katy Independent School District, shares legal and ethical issues involved in her leadership role.<br><br></div><div> # 1: Maintaining student confidentiality when discussing teacher and parent concerns about the student is the counselors key role. </div><div>  </div><div># 2: Knowing the limitations of confidentiality is important when it comes to counseling children in the school setting. Counselors have a legal and ethical responsibility to report student admissions of imminent self-harm or harm to others.</div><div>  </div><div># 3: Counselors are morally, legally, and ethically required to report suspected cases of child abuse. </div><div> </div><div># 4: Since the Santa Fe school shooting and the rise in student suicide, the school district is providing training on suicide threat and risk assessment to ensure counselors know the requirements for prevention and response. </div><div> </div><div># 5: When dealing with students of coworkers, counselors must practice care to maintain boundaries when it comes to dual relationships.</div><div> </div><div>(P.          <title>Option #2                              American School Counselor Association (ASCA) Legal and Ethical Issues</title>

         <description><![CDATA[<div>The latest news on the push for laws that include access to mental health services and  career development are some of current legal issues for education counselors.</div><div><br></div><div>The federal government has recognized a growing need for improving student’s mental health and wellness and have worked with ASCA to update and introduce an improved version of the Elementary and Secondary School Counseling Act. If passed, the bill would provide funding to states to lower the student-staff ratio of school counselors, psychologists, and social workers, ensuring more students would receive much needed services <br><br>Additionally, the Strengthening Career and Technical Education for the 21st Century Act (Perkins V) was recently signed into law, mandating school counselors plan and carry out career exploration and professional and career development programs for Career and Technical Education, providing students with skill needed to pursue high wage, in demand jobs.<br><br></div><div>(Legislative Affairs, 2019).</div>]]></description>

         <description><![CDATA[<div>Title IX of the Education Amendments of 1972 mandates that school counselors report bullying, dating violence, and sexual harassment to school administration and proper authorities for discipline, while personally providing services for victims and perpetrators. Additionally, school counselors are required by state and federal law to report child abuse and neglect and provide for their safety following reports. Finally, school counselors attend training and facilitate student and staff training for prevention and intervention of bullying, violence, and neglect (Legal and Ethical Standards, 2019).</div>]]></description>
