         <title>June 2020 - Bostock v. Clayton County, GA</title>

         <description><![CDATA[<div><strong>Issue:</strong> Does terminating someone's job based on their sexuality or <strong>sexual orientation violate Title VII of the Civil Rights Act of 1964.<br>Holding/Reasoning:</strong> In a 6-3 decision Supreme Court ruled that firing of an employee for the mere fact they are gay or transgender violates Title VII of the Civil Rights Act of 1964.<br><strong>Significance: </strong>Before this ruling in 52% of the states have clear laws that prohibit job discrimination based on sexual orientation.          <title>2017 Whitaker v. Kenosha Unified Sch. Dist.</title>

         <description><![CDATA[<div><strong>Issue</strong>: Does not recognizing a students chosen sexual identify and not allowing them to use the bathroom with which they identify violate their Title IX of the Education Amendments of 1972 and the Equal Protection Clause of the Fourteenth Amendment to the U.S. Constitution. <br><strong>Holding/Reasoning</strong>: District Court judge grants preliminary conjunction stating that student should be allowed to use the bathroom with which he identifies. Appeals court upholds this unanimously stating that transgender students' have rights protected under Title IX and the Equal Protection Clause. <br><strong>Significance</strong>: This was the first federal appellate decision that found Title IX requires public schools to permit students to use restrooms that go with their gender identify.</div>]]></description>

         <description><![CDATA[<div>This case is similar issue as Whitaker v Kenosha.&nbsp;<br><br>It has been decided by the United States Court of Appeals for the Fourth Circuit in favor of GG claiming the school board policy violate Title IX and that students should be able to use the bathroom that they identify with.<br><br>In February 2021 the school district files petition with the US Supreme Court asking them to hear the case. No decision has been decided.</div>]]></description>

         <description><![CDATA[<div>High school teacher sued the district stating that he was discriminated against and forced to resign based his religious beliefs that did now allow him to address transgender students by their preferred name/pronouns.<br><strong>Issue:</strong> Does forcing staff to address transgender students by their preferred name/pronouns violate the first amendment. <br><strong>Holding/Reasoning</strong>: the federal district court found that the school district's policy regarding addressing students by their preferred name and pronoun</div><div>was neutral and applied to all teachers, regardless of religious belief.</div>]]></description>

         <description><![CDATA[<div>After much research using the prior court cases and resources it is very clear that as a country we have made great strides in the past few years for the LGBTQ community, however, there is still a long way to go. Bostock v. Clayton County, GA was a huge milestone and really set the president for cases to follow. Many cases I saw after this decision stated using this case in their decision to hear the case or to grant the plaintiff injunction.</div>]]></description>

         <description><![CDATA[<div>It is necessary to use board policy along with these cases to really think about student and staff rights under Title IX and VII. Due to a lot of these policies dealing with LGBTQ being very fresh and new I also find it necessary to consult district representative and the district lawyer when an issue may arise at my school. </div>]]></description>
