Summary: With social media growing rapidly it is to be expected that there is great interest in what student athletes are putting out there for the world to see. Many times, student athletes are held to a higher standard by their team, which ties their hands in a sense of what they can say and do on their own public platforms. Many athletes try to argue this with Amendment 1 ( Freedoms, Petitions, and Assembly: Congress shall make no law respecting an establishment of religion or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press, or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances). Amendment 14 states that there is constitutional protection to property that rise to a "legitimate claim of entitlement". However, courts have determined that playing sports falls outside the scope of due process because it amounts to an expectation rather than a constitutionally protected claim of entitlement. So, playing these sports is more of a privilege and athletes must abide by their school's policies when it comes to what they post on social media.

Summary: 

It is a school counselor's job to address a students reasons for wanting to go where they want to after graduation. It is important that school counselors make sure student's are going somewhere for the right reasons. This is especially true concerning potential student athletes. Summary:

Student athletes may face several different legal issues post graduation. Some of these include:

• NIL Rights- Some students strike up major brand deals in college at the peak of their careers. They may or may not be able to continue at the professional level so it is important that they don't restrict future opportunities when structuring long term deals (Atwood, 2024).

• Employment Law- If athletes are reclassified as employees of the NCAA, it would stand to reason that many students may start to bargain for workers' compensation, health insurance, disability insurance, and other benefit programs. NCAA has worked hard to avoid giving these typical work benefits to athletes.

• Entrepreneurship- Many athletes will use their status to help them start their own business. Some legal challenges that may occur include business formation, intellectual property rights, and contract law.

• Intellectual Property- Many athletes choose to try to extend their brand beyond graduation with nicknames, personal names, slogans, or logos. These may be able to receive federal trademark protection establishing nationwide rights (Atwood, 2024). Some legal concerns here would include making sure the trademark does not create confusion with other trademarks, timely registration, using the mark in commerce to keep it alive, and enforcing rights against others who are infringing.

• Stay current on NCAA student athlete handbook updates.

• Develop and interest and understanding of what is important to each individual student athlete when it comes to choosing a university to attend.

• Connect with other counselor's who frequently deal with sending student athletes to universities.

• Provide students with several opportunities to visit, explore, or interact with current collegiate student athletes and get their stories and opinions on different aspects of being a student athlete.

• Provide student athletes and their parents an opportunity to receive a training or have an informational night concerning going to college as a student athlete and what to expect as well as current legal issues concerning collegiate athletes.

• Provide student athletes/parents/guardians with an opportunity to evaluate your program. This will give you an opportunity to receive feedback and strengthen your program.
