         <description><![CDATA[<div>Gives congress the expressed power. Many things in the U.S constitution can lead right back to the Necessary and Proper Clause. The Necessary and Proper Clause is mainly referred to as the "Elastic Clause." Later there was a charge for any bank who is doing business in the state. It was directed towards the second branch of the bank. As a bank cashier James McCulloch marked the "issued notes as no tax had been paid". The state won against him. Later the court unanimously reversed the Maryland courts, making the creation of the second bank "necessary and proper." the congress officially had been fixed into the Constitution system.</div>]]></description>

Those who apposed were Constructionists argued that nowhere in the Constitution granted congress to construct a bank. This dispute continued and grew larger, but in 1791 The Bank of the United States was created.</div>]]></description>
