         <title>How the 8th Amendment has changed over the years</title>

         <description><![CDATA[<div>When it was ratified in 1791, the eighth amendment caused a lot of controversy, which it still continues to do today. In the first few cases around this amendment, the judges and juries would usually side with the death penalty, which was still allowed in nearly all the states. A couple decades later, new forms of execution were brandished and many could be thought of as cruel. The death penalty is the main point of this amendment. In the last fifty years, only a handful of states don't allow the death penalty. Even though this amendment is supposed to protect citizens from excessive fines and cruel, unusual punishment, it  is still allowing it. This amendment needs to be enforced more properly and thought of with more concern than it seems to be given.</div>]]></description>
