         <description><![CDATA[<div>I interviewed Assistant Principal John Fleming at Premier High School. As an administrator, it is their mission to create a healthy and safe learning environment. When disruptions occur, such as gang activity or gang affiliation, it is the administrator's desire to halt unwanted behaviors expeditiously. However, there are policies and laws in place to protect a student's educational rights. Due process rights for students provide safeguards for students to receive a fair trial.<br>(J. Fleming, personal communication,&nbsp; April 26, 2021).<br><strong>Best Practices:</strong><br>* Schools should "develop a comprehensive, lawful Code of Conduct that address student behavior at school, related events, and on social media that impacts the school" (NACSA, n.d.).<br>* Schools should "consistently and uniformly implement the Code of Conduct"&nbsp; ( NACSA, n.d.).<br>* Schools should "establish a clear, lawful process for conducting disciplinary appeals. Make it detailed and explicit in order to provide maximum clarity" (NACSA, n.d.).<br><br><strong>Emerging Issues:<br></strong>School officials should stay updated on the changes in Texas schools related to the disciplinary actions towards gang affiliated students. Texas education Code Sec. 37.121 explains that "a person commits an offense if the person is a member of, pledges to become a member of, joins, or solicits another person to join or pledge to become a member of a public school fraternity, sorority, secret society, or gang"(FindLaw, 2020). However, specific school should also have their policies in place in regards to how and if disciplinary actions are warranted. School officials must stick to policies and procedures to adhere to due process laws. <br><br>National Association of Charter School Authorizer. They are also responsible for combating unwanted behaviors such as gang activity or affliction. However, it is equally important to afford students&nbsp; their due process rights (J. Fleming, personal communication, April 26, 2021).<br><br>*Offenses and consequences can by easily found on Responsive Ed's website. Staff, as well as students, should be aware of what is expected and consequences if expectations are not met (Responsive Ed, 2019).<br><br>*The National Association of Student Personnel Administrators provides an abundance of publications and resources to assist educators better serve their students. Ms. Treadwell provides a plethora of campus safety and violence prevention information (Treadwell, 2021).<br><br>*It is imperative that schools implement policies to combat gang activity. Family participation is an important aspect of implementing these changes (Chen, 2020).<br><br>*There are procedures in place for schools to respond to gang issues. Staff members should become knowledgeable of these procedures for when such issues occur (Chen, 2019).<br><br>*Schools should be proactive in setting the tone for the intended environment. The Code of Conduct highlights acceptable and unacceptable behaviors as well as consequences (NACSA, n.d.)</div>]]></description>
