         <description><![CDATA[<div>* 43 year old&nbsp;Ronald Ebens and his 22 year old step son, Michael Nitz were two white men who just recently lost their jobs at Chrysler. Many people including them blamed the decline of automotive manufacturing capital on Japanese car manufactures. <br>* These offenders were organized because the night of the murder, Ebens singled out and fought with Chin at the night club and then following Chin and his friend group to McDonald's, where Ebens got out a baseball bat from his car he was in, and smashed Chin's head while Nitz held Chin down. This attack was racially motivated and he has no remorse to killing Chin or understanding why the Asian community is outraged. <br>* If offender is a "serial killer", identify their motive based typography . Ebens and Nitz chased Chin away, until both men found Chin at a McDonald's parking lot. How were victims “chosen”?          <description><![CDATA[<ul><li>The killing was not meditated Chin picked the fight first with Ebens and Chin  the club. When they were both kicked out, Ebens searched for Chin and his friends to strike him with a bat. But Ebens and Nitz did not go to the club to find Chin specifically and kill him. It was more of a in the moment situation and Ebens and Nitz escalated the situation after being kicked out of the club </li><li>On June 19th, 1982, Vincent Chin and his friend group when to a Detroit, Michigan club for his bachelor party. While at the club, Chin and his friend group fought with Ebens and Nitz at the club after being called racial slurs by Ebens. Ebens&nbsp; blamed Chin for loosing their jobs at an automobile company due to American companies now buying from Japanese manufacturers. But Chin was Chinese decent, not Japanese. The fight was soon outside the club and Ebens went to his car and grabbed a baseball bat. He began chasing Chin&nbsp; with a baseball bat and Chin was able to get away. But soon, Ebens and Nitz tracked down Chin for almost 20 minutes in their car. There have also been clams that Ebens paid a man named Jimmy Perry $20 to find a "Chinese guy." Chin and his friend group were found at&nbsp; a McDonald's. Both men got from their car and Nitz held Chin down while Ebens beat Chin with a baseball bat. Four days later, Chin died from his injuries. Describe the <strong>sequence</strong> of event(s) in order. Be sure to give enough details to depict the entire scenario.</li><li>A police officer happened to be at the crime scene when it happened and claimed that Ebens was swinging the bat “for a home run”. Chin was rushed to the hospital unconscious and never woke up from his coma. Both Nitz and Ebens were arrested on the spot. How was the crime discovered / linked? Indicate buildings, houses, cities, countries, if/when appropriate. &nbsp;</li><li>This all occurred on the night of June 19th, 1982, when Chin and his friends arrived at the bar at 7:00pm. It is unknown when the fight between Chin, Ebens, and Nitz occurred and when they arrived at McDonald's. But at 9:50 on June 23rd, 1982, Chin's ventilator which kept him alive was removed and was pronounced dead. <strong>When </strong>did this occur?          <description><![CDATA[<ul><li>Chin's friend group who was there during the fight and attack while Ebens beat&nbsp; Chin's skull in while Nitz held him down at McDonalds(testimonial) All three members of the friend group heard the racial slurs and stated that the death of Vincent Chin was rooted in racism</li><li>The dancer at the club who heard Ebens calling Chin racial slurs and accusing him of stealing their jobs (testimonial) This piece of evidence was used against Eben's claim that this attack was not race related and that he just wanted to intimidate Chin, not wanting to kill him</li><li>Another incident in which Ebens was in a bar in 1974, in which he verbally assulted a black man at a bar named JoJo's.          <description><![CDATA[<ul><li>The motive of the killing of Vincent Chin was due to the bar fight that was racially provoked by Ebens and Nitz. What was the <strong>MOTIVE </strong>for the killing?&nbsp;</li><li>Eyewitnesses:&nbsp; Chin's friends, Choi, Sirosky, and Koivu</li><li>Highland police officers at the McDonald's parking lot Indicate any <strong>expert testimonie</strong>s, <strong>eyewitnesses&nbsp;</strong></li><li>On March 16th, 1983, a plea bargain was reached to reduce the charge to 3rd degree manslaughter.</li><li>They were both originally charged with 2nd degree murder and found not guilty on this charge because it was ruled that Chin started the altercation, neither defendant had prior convictions, and since Chin was alive on life support for 4 days, it did not come across as intent to murder&nbsp;</li><li>Ebens and Nitz were charged with 3 years probation, $3000 fine, and $780 in court costs Were they found <strong>guilty </strong>/ not <strong>guilty</strong>? On what <strong>premises</strong>?&nbsp; If not guilty, under which premise(s) (ex: insanity, insufficient evidence, etc)&nbsp;</li><li>The Asian community was rightfully outraged of this outcome and the murder of Vincent Chin was primarily the spark of Asian American Civil Rights&nbsp;</li><li>The Americans Citizens for Justice was created two weeks after Ebens and Nitz sentencing and protested the sentencing. They petitioned for the US Department of Justice to investigate the murder as a civil rights violation</li><li>The Department of Justice was able to conclude that his murder was a civil rights violation&nbsp;</li><li>In 1984, the US District Court sentenced Ebens to 25 years in prison for violating Chin's civil rights. But in 1987, Ebens received a retrial, which cleared him of his sentencing.&nbsp;</li><li>This was the first time the law was able to protect Asian Americans in a federal civil rights prosecution.
