Would a murder of a six year old, in which they were tortured, burned and recorded have an adequate punishment? NO, but certainly not death.

The question here really is, would an eye for an eye really be capital punishment? No. A punishment for an absolute HEINOUS murder of a child does have an equal punishment, but it is not a compassionate needle full of heart stopping syrup. Does the episode "White Bear" take it to far by a never ending torture? Possibly, but only from an outside perspective. If you are the one who lives a nightmare everyday, but you can't remember the day before, does it really count as timeless sentence? The physiological effects may come into play eventually, but does entrapping a child in a sleeping bag and burning alive have an ending in the sorrow?

Kennedy v. Louisiana US Supreme Court, 554 U.S.___ June 25, 2008

Petitioner Patrick Kennedy was convicted and sentenced to death in Louisiana for the aggravated rape of his then 8 year-old stepdaughter. A Louisiana state statute authorized capital punishment for the rape of a child under 12. The State Supreme Court affirmed the statute, rejecting petitioner’s reliance on Coker v. Georgia, which prevented the use of capital punishment for the rape of an adult woman. The Supreme Court concluded that the Eighth Amendment bars Louisiana from imposing the death penalty for the rape of a child where the crime did not result, and was not intended to result, in the victim’s death.

The Excerpt to the left of this Padlet box, is a description of a case in the U.S. Supreme Court right now. Wouldn't death be a nice escape from the life prison sentence for rape of an 8 year old little girl? Does a life prison sentence even give justice? There needs to be something beyond the death penalty. Hard labor, endless torture (?), mentally harrowing experiences? Death is too easy of an escape for a crime that destroys the life of another. That eight year old will never see other humans the same. Trust has been broken, and the road to recovery much harder than having to wake up to a world of Hunters and Onlookers!

The Argument For the Death Penalty

People who claim the death penalty over life in prison is the more cost effective and least burdening on tax payer way to serve justice, are RIGHT. Well presumably. The costs of both are very difficult to track, and death penalty convictions often spend years in courts costing time and money just as prison does. But if the appeal process could be shortened capital punishment would almost certainly be cheaper on tax payers... Problem is, death, while "scary" is an easy out form real punishment!

Death is often thought of as the ultimate ending. A punishment for bad guys who don't know how to give in. Perhaps an ending for criminals and junkies who don't know how to get their acts together. But when death is looked at from a punishment point of view, one can argue its the easy way out! Rape and torture, especially of children, need something other than the escape of forever lasting sleep. Hard labor! When hard labor in prison could be seen as slavery to a degree, but is it slavery if its deserved? Slavery should be a word saved for undeserving forced labor. 24 hours on - 4 hours off of digging trenches with restricted access to water seems more fit for a child rapist than death.
