Vale<br>-state of Louisiana<br><br><strong>Why did Vale's home have to be searched?</strong><br>Vale had a warrant for his arrest on narcotics charges. While staking out his home, the police saw what they thought to be a drug deal. Vale was arrested outside of his house and his house was searched without a warrant. During the search, narcotics were found in a back room.</div>]]></description>

         <description><![CDATA[<div><strong>Did the case violate Vale's fourth amendment rights?<br></strong>The search did violate Vale's rights described in the fourth amendment because his arrest took place outside of his house, yet the police searched inside and ended up discovering heroin.  If he had been arrested inside the house, then this search would have been legal and this evidence could have been used against him in court. Also, the police did not have a warrant and while this is not always necessary, there are few cases where it is acceptable.</div>]]></description>

         <description><![CDATA[<div><strong>When did this occur?</strong><br>Argued- March 4-5, 1970<br>Decided- June 22, 1970<br>Granted- October 13, 1969<br><br><strong>What was the outcome of the case?</strong><br>Ultimately, the evidence from the search was thrown out in court because Vale was arrested outside of his home, so the police did not have the legal right to search anywhere where the arrest did not take place. Also, they did not have a warrant, and this search was not justified enough to let this pass.</div>]]></description>
