         <title>The issue of recognition has been painting for 12 years and has been communicate the message to the headquarters in Paris. They (IUF) believe that by signing agreement would be an understanding with the Club Med– recognizes the fundamental approach of forming a union or the workers are having a legitimate right in choosing an organization or unit of their own choice. It might be dispute arise in collective agreement and can be settled by virtue of negotiation but recognition is a separate issue. They want a basic right to represent their workers working in Club Med so that the worker can begin work there but in improvement of better working conditions.</title>

In this interview, John have mention that secret ballot is not relevant anymore because this method took a long time and up to 2 years. Within that duration, most of the workers will resigned from their jobs. So, the consequence of their decision will make the organization don’t have enough workers.  <br><br></div><div>Next, John mention that the collective agreement is important for workers to protect their right. Also, the John believe that assistance will help them to communicate with the local management to settle the problem that union have faced. So, by having the right methods this will help the union to protect their right and have a better working condition and management. <br><br></div>]]></description>

         <description><![CDATA[<div>The video is about John Angelus of the IUF-affiliated National Union of Hotel, Bar and Restaurant Workers (NUHBRW) of Malaysia talks about the opposition of Club Med to recognising a trade union at a hotel in Malaysia and the role of the IUF. <br><br>They has been fight for more than 10 years to get the recognition of the trade union. The issue here is that the Club Med opposed the fundamental rights that should be given to the workers in which, human nature they need someone to guide or even a motivation to do their works and represent them if any disputes occured. By having their own Union, it will help the workers to have improvement, a better work conditions and to always have their own rights to claimed according to the collective agreement. <br><br>In my opinion, every workers have their own rights to choose their own union or organization to represent them to make sure that they are been secured by certain conditions if any disputes arise. Yes it can have disputes or opposed in collective agreement later but can be solved by negotiation, it is not fair by not giving them the recognition itself in which it is a basic right to represent their workers who worked in Club Med to have a better improvement and a good working conditions. </div>]]></description>

         <description><![CDATA[<div>The interview was make with John Angelus the IUF- affiliated National Union of Hotel, Bar and Restaurant Workers (NUHBRW) of Malaysia. In this interview, he said the recognition for trade union in hotel in Malaysia had been pending for almost 12 years. The most opposing group for this recognition was the Club Med. Club Med really oppose for this thing to happen. The big question is why ? <br>In my opinion, Club Med did not want anyone or any union were formed in tourism industry in which they have been in the industry since 1950. They have been protected the right of employees in tourism industry for many years, so they may think ,why need to form new union since they still exist and capable to protect their employees right.          <title>The interview have been made with the workers of IUF-affiliated National Union of Hotel, Bar and Restaurant Workers (NUHBRW) of Malaysia which is John Angelus. There is a method that the hotel are prefer to use which is secret ballot. However, this method is not effective because it take time for them to claim for recognition and also it cost thousands of money to the trade union. Moreover, IUF also expect the IUF in Geneva to communicate the problem to them or the kind of situation that the union is facing with the local management. They want IUF to explain to the management of Club Med that they can have dispute in collective agreement and it can be settled by virtue of negotiation. However, the recognition is a separate issues. It is not fair for the worker at Club med because they just want a basic rights to represent them so that they can work there for the improvement and better working condition.</title>

         <title>According to the video, we can clearly see that there are an issue between  UF -affiliated National Union of Hotel, Bar and Restaurant Workers (NUHBRW) of Malaysia and Club Med where Club Med did not want to recognize the proposed of formation of union.Even though Ministry of Labour has confirmed the formation of trade union, the Club Med still don’t want to recognize them. Unhappy with the Minister’s decision, the Club Med challenge it to the court of law. Indeed, the hotels prefer to use secret ballot. Secret ballot is not an effective method where it will conducted in such a long time period, where usually it will takes up to 2 years to be settled.In the mean time, the workers seek assistance from the IUF as they believe that IUF can communicate workers’ message to the headquarter. Other than IUF able to recognize the fundamental approach of forming a union and IUF also believe that workers have legitimate right in choosing their own rights. Thus, in my opinion, it is not fair for Club Med to prevent their workers in forming the trade union as the court also has approved their request to form a trade union. </title>

But Club Med refuse to approve the recognition and challenge to the court of law. While the minister already agree with the union. Club Med challenge again at Court of Appeal but the court support the union. While this case takes years and years, union refer to IUF to ask Club Med to not proceed at Federal Court. <br> Another issue is the collective agreement where both parties could not agree is the service charge. <br> Furthermore, employer use secret ballot to stop the trade union makes the employees unsatisfied because it takes time and some of the workers already resigned. <br> Back to the issue, the union don't want to extend the case and seek help of IUF to talk with club med that the union is open for negotiation regarding the collective bargaining. <br><br></div>]]></description>

         <description><![CDATA[<div><br> </div><div> </div><div>The issue is the recognition of the trade union has been pending until 12 years because the Club Med opposed the recognition. Therefore, they decided to seek for assistance from IUF to bring this matter to the headquarters in Paris and asked IUF to explain to them that the management in Club Med in KL is not honoring that fundamental right. In my opinion, it is not fair for the trade union to be recognized until that long period of time because it will demotivate the workers to have their rights. Apart from that, the methods of secret ballot is not an effective way because it takes a lot of time which during the time, workers may resign. In conclusion,  the workers have their right to choose which organization they want to join.</div>]]></description>

         <description><![CDATA[<div>Based on the video titled "Club Med and Trade Union Rights in Malaysia", an interviewer interviewed John Angelus from the National Union of Hotel, Bar &amp; Restaurant Workers (NUHBRW) in August 2009.</div><div><br></div><div>The video tells us that they already claimed for recognition for 12 years, but unfortunately Club Med did not want to give the recognition and challenge the matter at the court of law even after the case was reffered to the High Court. This matter has addressed to the the IUF Head Quarters in Paris, and Clubmed has agreed to not pursue the case to the federal court, but still, both parties are not agree to most of the term &amp; condition. John stated that IUF is important in this case because it can make IUF aware that this recognition case has not been settled for 12 years, also IUF can communicate to their Head Quarters in Paris because they have the understanding in forming the union. Through that, the management of ClubMed in Kuala Lumpur can have disputes in the collective agreement by negotiation or refer to the court.</div><div><br></div><div>In my opinion, what John seeks is right. But on the other hand, employees &amp; employers have their own rights to choose to be in union or not. John should consider what ClubMed feels and their objectives. It is true that they can have disputes in Collective Agreement, but doesnt it waste of time?          <description><![CDATA[<div>This interview is from John Angelus. He is General safety of (NUHBRW) in Kuala Lumpur. The worker wants to form a new union aside the clubmate. Then they are unhappy because they claimed their recognition to Ministry of Labor but the Ministry of labor decide that they will not give recognition. so they are unhappy then they challenge at Court of law. But still they are unhappy because they did not get their recognition. so, they appealed to high court and High court make a decision that the Union is right. Then they still want to appeal this case to the court of appeal and the court make a decision that favor the union. lastly, they try to subject this matter to IUF. They make an agreement with IUF and IUF also make some intervention and the they agree not to bring this matter to the Federal Court. But this is not the only issue about them, they also have issue regarding collective agreement. Mr. John Angelus stated that both party did not have a mutual agreement regarding the term and condition of service charge. The workers in hotel also decide to make secret ballot. But Mr. John stated that they did not have enough worker to join the secret ballot. Most of them already retrenched before this issue was settle down. Hence, they also expect the assistance from the IUF. They expect that the IUF can always communicate and tell them the problems or any situations that union is facing with local management. The clubmate also think that IUF is very effective in this case because they recognize the fundamental approach that the employees wants. Like the employees have the right to join any union that they likes. Overall the issue is about their recognition. Why they cannot form a new union and try to represent their worker so that they can have a right to claim for working condition.</div>]]></description>

They had follow the process of claiming the recognition, and even the Ministry of Labour had given the approval for recognition.<br><br>Unfortunately, Club Med still refuse to do so. I think there is reason why the Club Med refuse to give the recognition . In my opinion, Club Med do not want any union to be formed as an union may be the party that will intervening the enployee- employer relationship. By having the union, the workers may have motivation and some of issues that could be discuss for protect their right. Ministry of Labour also gave them approval for the union but still Club Med opposed their rights. In my opinion, Club Med should not act like that because workers also have their right issues to be discuss and it may take time too long for the approval. But, in opposite side of my opinion there must some reason Club Med really opposed them. It could be to prevent the employers to have absolute rights to their employee.
