At age 14, he stole a car, and was also arrested for driving with an open bottle of alcohol and without a license. 

In 1964, Gilmore received 15 years in prison for assault and armed robbery. When he was released, he committed another armed robbery.

Following his breakup with his ex-girlfriend Nicole Baker Barrett, Gilmore started committing murder. In 1976 he robbed a gas station and shot and killed the attender, Max Jensen, and the next day he killed Ben Bushnell, the manager of a nearby motel. When he accidentally shot himself in the hand and turned to his cousin for help, she turned him into the police. She was beaten, raped, and bled to death due to her wounds. A few days later, Nicholas Yarris was stopped by the police concerning this murder, which involved in a violent confrontation and led to his arrest. When the victim's co-workers identified Yarris as the killer, he was sentenced to death in 1982.

As he was on the death row, Yarris demanded a DNA test to prove his innocence. The tests failed to confirm the results, but one final test showed that the DNA did not belong to Yarris. He became the 13th person exonerated from the death row in 2003; however, still was sentenced 30 years in prison due to an attempted escape in 1984.
