1.Intent/purpose
If the intent is of public interest, then the work may be considered ethical. However, when the work is used to the benefit of certain parties (eg. political parties, specific groups of people) where other people's rights may be compromised, then it may be unethical
2.Transparency
In other words, the degree of transparency. the mathematician should be able to show how his/her work is being applied as well as its implications, as a proof of his/her commitment to being ethical

If the mathematician is directly involved in the act of crime then yes however if it's just his/her theories being misused by someone else and the mathematician had no contact with that person , relation or whatsoever then that's a different case.

If the work is being misused we can look at who is misusing that work because if the mathematician is the person misusing it then they should be held responsible, however, if it is someone else then the mathematicians shouldn't be held responsible as they are not the ones using it

This may be due to the fact that Mathematicians are experts at processing data, statistics and numbers to recommend a solution. Therefore, I think that there would not be a definite criteria as to make Mathematicians responsible for unethical applications of their work. If the work has a large negative impact on a certain thing (for example election), the mathematician should be responsible for it.
